New Landlord/Tenant Provisions in Minnesota for 2024: During the 2023 State Legislative Session, new provisions were enacted that impact landlord’s and tenants alike. Many of those changes have not yet been felt, as the new laws become effective in Minnesota on January 1, 2024. There are several changes in the law that landlords and property management companies should familiarize themselves with as those changes come into effect after the New Year. 14 Day Written Notice Requirement for Nonpayment of Rent/Fees Evictions. Before, many landlords in Minnesota would provide some form of a notice, often a 3-Day Notice of Intent to Evict, as a means of pre-filing notification to tenants who may be facing an eviction due to nonpayment. Such notice was not a specific prerequisite to filing an eviction on a tenant who is not paying the rent in Minnesota. However, as of January 1, 2024, Minnesota landlords will now be required to provide tenants in rent arrears with a written 14 Day Notice of Intent to Evict before filing for an eviction. The written notice must be delivered personally or by first class mail to the residential tenant at the address of the leased premises. Additionally, the 14 Day Notice must include: The total amount due from the tenant; A specific accounting of the amount of the total due from unpaid rent, late fees, and other charges under the lease; The name and address of the person authorized to receive rent and fees on behalf of the landlord; Inclusion of these specific statements: “You have the fight to seek legal help. If you can’t afford a lawyer, free legal help may be available. Contact Legal Aid or visit HYPERLINK "http://www.lawhelpmn.org" www.lawhelpmn.org to know your rights and find your local Legal Aid office.” “To apply for financial help, contact your local county or Tribal social services office, apply online at MNBenefits.mn.gov or call the United Way tool-free information line by dialing 2-1-1 or 800-543-7709” “Your landlord can file an eviction case if you do not pay the total amount due or move out within 14 days from the date of this notice. Some local governments may have an eviction notice period longer than 14 days.” The landlord must wait 14 days (or longer if a municipal or county government has implemented a longer notice period) before filing the eviction action with the Court. This change to the law is specific to nonpayment evictions only, and does not impact evictions for material breach of lease, or other statutory reasons. Lease Agreement Fee Disclosure Requirements. As of January 1, 2024, all new lease agreements for residential properties in Minnesota are required to disclose all nonoptional fees contained in the lease agreement. Under the new law, the sum total or rent and all nonoptional fees must be described as the Total Monthly Payment and be listed on the first page of the lease. Additionally, when advertising a unit for residential lease, landlords are required to include a disclosure of the nonoptional fees included with the total amount for rent in any advertising or posting. Landlords also must, both in the lease agreement and in any advertisement, disclose whether utilities are included or not included in the rent. In short, the first page of the lease must set out the Total Monthly Payment reflecting rent and all nonoptional monthly fees owed to the landlord each month, and further must indicate whether or not utilities fees are included in the rent. These same items must also be included in any advertisement or posting for an available residential unit. Landlords who violate theses disclosure requirements may be liable to a residential tenant for treble damage and the court may also aware a tenant reasonable attorney fees. As such, landlords and property management companies operating in Minnesota should update their internal policies and lease agreements to ensure compliance after the New Year, and make contact with their attorneys if they have questions.
