Post-nuptial agreements help married or civil partnered couples define financial arrangements after marriage, especially regarding divorce or a partner’s death. For enforceability in the UK, agreements must include full and fair financial disclosure, voluntary and informed consent, freedom from duress or undue influence, and independent legal advice for each spouse. Courts assess balanced terms, possible future scenarios, and factors such as children’s welfare and statutory guidance under the Matrimonial Causes Act 1973.
