Marlborough Park Estates Owners Association, Inc. establishes an Assessment Collection Policy effective immediately, setting out a staged process for delinquent assessments, including late fees, written reminders, and possible referral to collection agents. The procedure authorizes recording of notices of lien for accounts significantly past due, application of payments in a defined statutory order, and acceptance of payment plans under specific conditions. For longer delinquency, the board may pursue small claims judgments or attorney-led collection, including lawsuit or foreclosure, with all collection and legal costs the property owner’s responsibility.
