California pre-adverse action letter template. A letter informing you that a background check has led to an unfavorable decision against you is known as an Adverse Action Letter. Many organizations, including employers, volunteer groups, property managers, and loan providers, require individuals to undergo formal background checks before being accepted. A background check can reveal vast amounts of information about an individual, such as employment history, criminal/driving records, social media profiles, education history, and more. **What is Adverse Action?** Adverse action refers to a decision that results in the denial or rejection of an individual based on information derived from a background check. This can apply to various areas, including employment, credit, housing, and others. **When is it Required?** Organizations are legally obligated to provide a post-adverse action letter whenever they use information obtained from a background check to reject or deny an individual the report was acquired for. Such actions include not hiring, promoting, lending, renting, or accepting the individual. **Instructions: Writing Adverse Action Letters** To create an official adverse action letter: 1 . **Date and Recipient Name**: Enter the date (mm/dd/yyyy) the letter was delivered to the recipient, followed by their full name. 2. **Signature of Rejecting Person/Entity**: The individual responsible for denying the candidate based on information contained in the report should sign their name. You can use eSign or other electronic signature tools. Note: When relying on artificial intelligence or complex credit models, some creditors may use CFPB sample forms for adverse action notices, even if those reasons do not accurately or specifically apply to the situation at hand. To justify adverse action, creditors must provide specific reasons that accurately indicate the principal cause(s) behind their decision. Simply relying on a checklist of common reasons without ensuring they are specific and accurate will not meet ECOA requirements. The Equal Credit Opportunity Act (ECOA), implemented through Regulation B, prohibits discrimination in credit transactions based on various factors. To prevent and identify discrimination, creditors must provide a statement of reasons for adverse action taken, which must be specific, relate to actual factors considered, and accurately describe the decision-making process. The Consumer Financial Protection Bureau (CFPB) offers sample forms that creditors can use to fulfill their adverse action notice requirements, including a checklist of common reasons and an open-ended field for additional explanations. While these forms provide examples of commonly considered reasons, they are illustrative and may not be suitable for all creditors. Reliance on the sample forms alone is insufficient; creditors must ensure that the disclosed reasons are specific and indicate the principal reason(s) for adverse action taken. The use of complex algorithms involving artificial intelligence and predictive decision-making technologies in underwriting models raises concerns about consumer surveillance and the risk posed by data not typically found in credit files or applications. The CFPB has highlighted the potential harm from consumer surveillance, emphasizing the importance of transparency and fair practices in the credit industry.
