WHERE FOREIGN STUDENTS' RIGHTS END - Mike Arkush - (CPS) Staff Reporter Story

Sep 30, 2026

“Where Foreign Students' Rights End” examines how foreign students’ constitutional protections can effectively stop at the border when scholarship-linked restrictions and government decisions come into play. It follows a Bahraini student exiled after a routine re-entry exam, denied without meaningful appeal or due process, and details how colleges, sponsors, and the INS interact. The article highlights the McCarran Act framework, growing recruitment pressures, and the practical limits of recourse for students facing removal.

The student didn't make it. Without warning, with very little appeal, and apparently against his will,thestudent--vaguely accused of but never charged with carrying "subversive literature"--was flown to his home country. The Bahrainian government, which sponsored the student's scholarship, won'tanswer questions. The educators who originally lured the student to this country denyany responsibility for protecting the rights of the foreigners they recruit. And theU.S.government won't even reveal the student's name. "It happens all the time,"notes Dr.Joe Neal, foreign student advisor at the More on next page Continued from previous page University of Texas and one of the people who recruited the now-exiled student. Indeed,Dave Vandersall, the INS'deputy regional commissioner in Burlington,Vt.,estimates that 50 aliens with U.S.visas are denied re-entry into this countryeach year. And the problem of protecting aliens'rights becomes even more pressing now be-cause of American colleges'increasingly-intense recruitment of foreign students.Universities lure about 350,000 foreign students to campus each year,a number whicha recent study predicted might increase to 750,000 by 1990.Aliens currently accountfor 2.5 percent of the American student body. The reason for the growth is mostly economic,as universities seek to reversedeclining enrollment trends."Foreign students pay full tuition, usually live in un-iversity housing, and eat university food,"Philip Doughty of Syracuse University toldCollege Press Service last spring,"All of which makes them a good buy." Once here, however, they aren't necessarily afforded the constitutional rightsto free speech and due process that native students get. If someone --the agency that sponsors the student's scholarship, the student'shome government,or even the U.S.government--decides the student should be removed, the student has few recourses. "Various governments and agencies and companies and ministries sponsor thesescholarships,"Neal explains,"and scholarships have a way of ending. If they violatethe restrictions

FAQs

What legal basis did the INS use to deny re-entry?

The INS relied on the McCarran Act of 1951, which empowers Customs officials to bar entry for individuals judged to engage in activities prejudicial to the public interest.
