WITNESSETH The Board and the Association have a statutory obligation,pursuant to Act 379,of the MichiganPublic Schools act of 1965,to bargain with respect to hours,wages,terms and conditions ofemployment. The parties,following negotiations,have reached certain understandings,and it is agreed as follows: ## ARTICLE I RECOGNITION A.The Board recognizes the Association as the exclusive bargaining representative as definedin Section II,of Act 379,Public Acts of 1965,for all certified teaching personnel,includingfull time classroom teachers,part-time classroom teachers,media specialists,non-certifiedand/or non-endorsed teachers,and special education teachers,but excluding supervisory andexecutive personnel,substitute teachers,office,clerical,maintenance,operating employees,and all others employed by the Board.Non-certified,non-endorsed teachers may be hiredonly in emcrgency situations for a maximum of one(1)year.After forty-five(45)consecutivc days in the same assignment in a school year,a substitute teacher will earnstarting salary wages and become a permanent substitute. B. Supervisory and executive personnel who teach more than 1/2 time a day shall beconsidered teachers and shall be covered by this agreement. C. The term "tcachers"when used hereinafter in this Agreement,shall refer to all employeesreprcsented by the Association in bargaining unit as abovc defined.A probationary teacheris a teacher who has not attained tenure teacher status. D. Thc board agrees to not negotiate with any teachers'organization other than the Associationfor the duration of this Agreement. ## ARTICLE H BOARD RIGHTS A. The Board on its own behalf and on the behalf of the electors of the district hereby retainsand reserves unto itself,without limitation,all the powers,rights,authority,duties andresponsibilities conferred upon and invested in it by the laws and the Constitution of theSate of Michigan and of the United States,including but without limiting the generality ofthe foregoing,the right: 1.To the executive management and administrative control of the school system andall its properties and facilities,and the activities of its employees while suchemployees are on duty. 2.To hire and dismiss all employees subject to the pro
