Magistrate Amira Sariaty Zainalordered the case to be transferredafter the prosecution obtainedconsent to prosecute under Sec-tion 177A of the Criminal Proce-dure Code. Defence lawyer Kitson Foongconfirmed that the case was setfora full trial now that it had beenmoved to the High Court. "The charge currently stands asSection 302 of the Penal Code formurder.The prosecution hasevaluated the evidence and be-lieves it is sufficient for the mur-der charge to proceed. "We respect that and we will seethem at the High Court for a fulltrial,"he said after case manage-ment proceedings. Earlier this month,a three-month psychiatric assessment byHospital Bahagia Ulu Kinta direc-tor Dr Ian Lloyd Anthony foundthat the boy was fit to stand trial. Foong said,at their request,themagistrate had ordered the caseto be prioritised at the High Courtfor case management. "This is so that we can actquickly in the best interest of thechild to fixa hearing date. “Everything is ready fortrial,sowe hope authorities at the HighCourt registry will facilitate this. "The trial will proceed once weknow which judge will presideand when it will take place.” Deputy public prosecutors Raja Zaizul Faridah Raja Zaharudin and Aqharie Durranie Aziz ap-peared for the prosecution. The boy,who cannot be pub-licly identified as he is a juvenile,is currently placed at the PuncakAlam Correctional Centre. He was present at the proceed-ings and was brought into thecourtroom via an internal routeclosed to the public.His parentsand a sibling were also present. Proceedings were closed to themedia and no photographs orvideos were allowed.On the boy's condition,Foong said he was showinggood progresswith the treatment,medicationand counselling at the centre,adetention facility forjuveniles. The boy was charged with themurder of his schoolmate at thegirls'toilet of SMK Bandar UtamaDamansara (4)between 9.20amand 9.35am on Oct 14.No plea wasrecorded as murder cases are un-der the High Court's jurisdiction. The charge provides for thedeath penalty or 30 to 40 years injail and 12 strokes of the rotanupon conviction.
