Sub Continuing ruthless atrocities on retired ST officials of Maharasthra in flagrant and brazen faced infringement of Statutory CCS Pension Rules 2021 and also in utter transgression of orders of DOP& T Ref 1. Letter of this Association SNPWA/ CHQ/ Secy( T)/1/25 dated 22nd Jan, 25. 2. DOP&T order 41034/1(ii)/2022-Estt.( Res-I) Dated 29th March, 23 Sir Vide letter under Ref 1, it has been adequately and unambiguously brought out and established how about 300 hapless retired ST officials of MH, in utter contempt and naked infringement of the provisions of Statutory Pension Rules, 21, relating to payment of Pension and Terminal Benefits, are being fleeced and tortured by BSNL Management and DOT for last four years on untenable, frivolous and concocted grounds of caste verification. As regards Onus of verification of Caste, the order of DOP& T at Ref 2 above, in nouncertain and ambiguous terms, lays down that the entire responsibility of carrying out caste verification lies unequivocally on the EMPLOYER and that Employee has no role whatsoever to play. The provisions of the aforesaid order at Ref 2 state However, instances have come to notice that the appointing authority has taken an unduly long time in getting the caste status of an employee verified through the concerned state authorities and the pensionary benefits of such employees have been withheld on the ground that their caste verification is pending.Such action on the part of the concerned authorities of the Ministties/ Departments of the Government of India is totally in contravention of the existing instructions. The Parliamentary Committee of the welfare of SC and ST have taken a serious view of it Sir, we completely fail to understand under which Rules of DOP& PW and DOP& T are being retired ST employees of MH victimized and ruthlessly tortured by both BSNL and DOT by withholding their Pension and Terminal Benefits when no disciplinary/Judicial or proceedings of any kind whatsoever are pending against them at the time of their retirement. DOT, instead of acting sternly against BSNL Management for their abject and unpardonable failure to comply with the orders of DOP& T regarding timely caste verification of these ST officials, is being complicit to withholding of Pension and Terminal Benefits of these employees. Miserable failure and serious lapses of BSNL Management in not carrying out the caste verification of these ofgicials during their entire service period is being illegitimately and ignominiously covered by DOT and, in the process, these hapless retired ST officials, are being contemptuously made the scape goats. It is completely incomprehensible and intriguing as to how and under which Rules has BSNL brazen facedly charge sheeted these officials after three years of their clean retirement. Just to cover up its misdeeds, serious lapses and dereliction of duties has the BSNL Management resorted to this abominable, outrageous and highly condemnable action of witch hunting by falsely implicating and framing up hundreds of downtrodden and underprivileged retired employees and their families by unleashing and inflicting incalculable and unbelievable atrocities on these employees. And, on the top of it, how has DOT, as an Administrative Ministry, been complicit to such heinous actions of BSNL, ignoring that all this is being perpetuated in complete contravention and disregard of Statutory orders of DOP& PW and DOP& T. Overseeing the implementation of these instructions and orders needless to say, becomes the bounden duty of DOT which it abjectly and deliberately abdicated. Sir, against the background of these atrocious acts of BSNL, we seek your immediate personal Intervention, to render Justice, on a war footing basis, to these hapless retired ST employees of Maharasthra who have been and continue to be ruthlessly trampled over by both BSNL Management and DO
