Public Disclosure Authorized Public Disclosure Authorized India Second Tamil Nadu Road Sector Project Redacted Report June 2021 Statement of Use and Limitations This strictly confidential report (the Report) was prepared by the World Bank Group (the “WBG”) Integrity Vice Presidency (“INT”) . It provides the findings of an INT administrative inquiry (the“Investigation”) into allegations of corrupt, fraudulent, collusive, and/or coercive practices, as defined by the WBG for the purposes of its own policies, rules and procedures (the “WBG’s Anticorruption Framework”), in relation to WBG-supported activities. The purpose of the Investigation was to allow the WBG to determine if the WBG’s Anti-corruption Framework had been violated. This Report is being shared to ensure that its recipients are aware of the results of the INT Investigation. However, in view of the specific and limited purpose of the Investigation underlying this Report, this Report should not be used as the sole basis for initiating any administrative, criminal, or civil proceedings. Moreover, this Report should not be cited or otherwise referred to in the course of any investigation, in any investigation reports, or in any administrative, civil, or criminal proceedings. This Report is provided without prejudice to the privileges and immunities conferred on the institutions comprising the WBG and their officers and employees by their respective constituent documents and any other applicable sources of law. The WBG reserves the right to invoke these privileges and immunities, including at any time during the course of an investigation or a subsequent judicial, administrative or other proceeding that your authorities may pursue in connection with this matter. Background In May 2015, the International Bank for Reconstruction and Development (“IBRD” or the “World Bank”) 1 and the Republic of India entered into a Loan Agreement to finance the Second Tamil Nadu Road Sector Project (the “Project”) . On the same day, the World Bank and the State of Tamil Nadu entered into a related Project Agreement (the “Project Agreement”) . The Project became effective in July, 2015 and is scheduled to close in June, 2021. The Project seeks to increase road capacity, enhance quality of maintenance, improve safety, and support the institutional development of Tamil Nadu's core road network. Department A is the Project’s executing agency. In October 2014, Department A issued Bidding Documents for a road construction and highway maintenance contract (the “Contract”) . In December 2014, a joint venture led by Company A, in partnership Company B, submitted a bid for the Contract. In February 2015, Department A rejected all submitted bids for failure to meet specific experience criteria and moved to retender the Contract. In April 2015, Department A issued second Bidding Documents with additional specific experience requirements (the “reissued Bidding Documents”) . In response, in June 2015, Company A submitted a second bid for the Contract. In August 2015, Department A and Company A signed the Contract Allegations & Methodology The World Bank Group Integrity Vice Presidency (“INT”) received a complaint that Company A was ineligible to bid for the Contract because it did not meet the specific experience criteria required in the reissued Bidding Documents. As part of its investigation, INT reviewed project and procurement documents, interviewed witnesses, and verified documents. 1 The IBRD is one of the five institutions that comprise the World Bank Group. The International Development Association (“IDA”) and IBRD constitute the World Bank.
