aboutWorkers'Compensation \n# The Way It Was\n\nIn the early 20th century,a worker injured on the job had to sue hisemployer to recover medical expenses and lostwages \nLawsuits took months and sometimes years.Juries had to decidewho was at fault and how much,if anythingwould be paid,In mostinstances, the worker got nothing. It was costly, time consuming, andoften unfair. \n# The Way It Is\n\nToday,the California workers'compensalion law provides a faster, fairerway to take care of injured workers...where fault doesn't have to beproved to recover medical expenses and lost wages. \nThis job-injury insurance is paid for by your employer and supervisedby the state. It pays your medical bills and if you can't work due to a job-related injury or illness, provides money to help replace lost wages untilyou can return to work. \n# Who's Covered?\n\nAlmost every employee in California is protected by workers'compen-sation,but there are a few exceptions.People in business for them-selves and unpaid volunteers may not be covered.Maritime workers andfederal employees are covered by similar laws.If you have a questionabout coverage, ask your employer. \n# What's Covered?\n\nAny injury or illness is covered if it's due to your job.It can be causedby one even like a fall,or repeated exposures, such as repetitive motion overtime.Everything from fist-aid typeinjuries to serious accdents is covered.Workers'compensation even covers injuries-including physical or psychiat-ric injuries-resulting from a workplace crime.(Some injuries from voluntary,off-duty recreational, social or athletic activity-for example, the companybowling team-may not be covered.Check with your supervisor or the caimadministrator listed at the end of this document if you have questions.) \nCoverage is automatic and immediate. There is no qualifying period, noneed to earn a certain amount in wages before you're covered...protec-tion begins the first minute you're on the job. \n# What You Have To Do\n\nf you have a work injury or illness, immediately notify your supervisoror the employer representative listed on the back of this pamphlet soyou can get medical help right away.If it's more than a simple first-aidinjury,your employer will give you a claim form so you can describe theinjury and how, when and where it happened. To file a claim, completethe \"Employee\"section of the claim form, keep one copy and return therest to your employer.Your employer wil then complete the \"Employer\"section,give you a signed and dated copy of the form, keep one copyand send one to the claims administrator, the company that is responsi-ble for handling your claim and notifying you about your eligibility forbenefits. \nBenefits can't start until the claims administrator knows of the injury, soreport the injury and file the claim form with your employer as soon aspossible.State law requires employers to authorize medical care withinone working day of receiving a claim form, and employers may be liablefor as much as $10,000 in treatment until a claim is accepted or reject-ed.Delays in reporting may delay workers'compensation benefits, andyou may not be able to get beneits if you don't file a claim within oneyear of the date of injury, the date you knew the injury was work related,or the date benefits were last provided. To ensure your right to benefits, report every injury,no matter how slight, and request a claim form if it'smore than a minor injury requiring only first aid. \n# Benefits\n\nThe Califomia workers'compensationlaw guarantees you three kinds of benefits \n■ All reasonable and necessary medical care for your injury or ill-ness...with no deductibles.Medical benefits may include treat-ment by a doctorhospital services, lab tests,x-rays,physical ther-apy and medicines.State law makes non-emergency medical ser-vices subject to preauthorization and limits some medical services. \n■ Tax-free payments to help replace lost wages while you are temporarilydisabled.Additional payments are made if the injury causes a perma-nent
