While essential to best practice hiring, background checks must be job-related and conducted in compliance with policy and state and federal laws.\nThe purpose of this document is not to provide legal guidance.  Instead, its goal is to provide general information on administering pre-employment background checks.  Unanswered questions of employment law may be addressed with the Attorney General’s office.\nAgencies must conduct background checks as required by statute, MN Rule and statewide policy.  In addition, agencies must ensure background check(s) are job-related and consistent with business necessity.  Conducting background checks as part of the hiring process can result in better hires with fewer post-hire problems.\nBackground checks are strongly recommended when job duties involve the health, safety, or welfare of clients or the public.  Job-related background checks maximize the agency’s opportunity to uncover information relating to whether the applicant poses any risk to the health, safety or welfare of clients or the public.\n\u000fWHY CONDUCT BACKGROUND CHECKS\nThe appointing authority is responsible for verifying all job-related information on prospective employees for civil service positions.  (Minnesota Rule 3900.7500)\nBackground checks also assist in identifying the best qualified candidate(s) and may be conducted:\nrelatively early in the hiring process to assist in identifying a smaller group of finalists, or\nat a later stage, to help select one candidate from among finalists, or\nafter a final selection has been made, but before an offer of employment, as a means of verifying job-related information.\nException:  A public employer may not inquire into or consider the criminal record or criminal history of an applicant for public employment until the applicant has been selected for an interview by the employer.
