The purpose of this article is to provide a broad and basic framework for learning to take and defend depositions. In this way, as your practice grows and you get more deposition experience, you can work on honing your techniques, ethically using tips and tricks, and avoiding traps. \nUnderstand \nAt the outset, you need to understand the nature of the case, the specific claims you are trying to prove or defend against, and the facts as they have been developed so far, and, in particular, those facts that are material and in dispute. Read the relevant pleadings and motionsand make sure to speak with the senior attorney on the case if you have any questions or need clarification. It is better that you ask questions upfront than be called to answer for them later. If you don’t have a good grasp on the case, then you may not recognize when a witness provides you a golden nugget or when a witness says something that underminesa key fact or theory in your case. \nNext, you must understand the purpose of the particular deposition for which you are preparing. Is it a corporate representative (Rule 30(b)(6)) who is simply authenticating documents? Are you taking the deposition of the plaintiff in a discrimination and retaliation suit? Are you defending your medical expert in a malpractice claim? Is the deponent a neutral witness to some crucial events in the case? Knowing the purpose of the deposition and the importance of the particular witness allows you to define your areas of inquiry, develop an approach to the witness, recognize how hard to push for answers, and determine what type of witness preparation is necessary. If you’re taking the \ndeposition, you need to have a written checklist of the facts you want to establish or the legal theories you want to foreclose. If you’re defending a deposition, you need to anticipate what opposing counsel is going to ask and where you are likely to have to make objections. \nOnce you understand the case and the purpose of the deposition, it’s important to try to understand opposing counsel’s reputation and style. Is he or she a straight shooter? Aggressive? Conversational? Tricky? Hostile (toward witnesses or counsel)? Highly experienced or relatively inexperienced? If you haven’t had many opportunities to deal with the counsel who will be on the other side of the table at the deposition, review her website, bio, LinkedIn page, and recent cases. Speak to other attorneys in your firm or other close colleagues to gain insights about her. If you’re taking the deposition, this should help you prepare for the onslaught of objections you may face, improper speaking objections, and other disputes. If you’re defending the deposition, you can use this information to better prepare your witness to be wary of tricks and traps, to keep calm in the face of hostile or harassing questioning, and to reinforce the need to avoid being lulled into a conversation or volunteering information. \nYou also need to know the state or federal rules, local rules, and any discovery guidelines issued in the jurisdiction. First, this means confirming which jurisdiction’s rules apply if the deposition is conducted outside the jurisdiction where the case is being heard or if the deposition is being conducted remotely by telephone or video. You should also be familiar with what form objections are proper and what objections are waived if not made; when and how you may instruct your witness not to answer and what other actions may be necessary if you give that instruction (e.g., seeking a prote","cbCaitrWA0xSRI7e","https://ap.wps.com/l/cbCaitrWA0xSRI7e","pdf",2108752,"English","# Understand\n## Case nature and material facts in dispute\n## Purpose of the deposition and witness focus\n## Opposing counsel style and reputation\n## Applicable rules and discovery guidelines\n# Prepare\n## Personal preparation and deposition outlines\n## Objections readiness and judge contact\n## Exhibit preparation and exhibit lists","[{\"question\":\"What should younger attorneys understand before preparing for a deposition?\",\"answer\":\"They should understand the case nature, the specific claims and facts at issue, and the material disputes.
