It is only a sample and can be used in conjunction with the Member Payment Summary and Provider & Facility Directory to create a Summary Plan Description. Accompanying this sample is a cover letter explaining the purpose of the sample and how it can assist the Plan Administrator. \u000b\u000bIf you would like an electronic copy of this sample wrap document, or if you have any questions, please contact Heidi Castaneda at 801-442-7067. \u000fSAMPLE SPD WRAP DOCUMENT
Dear Employer:
SelectHealth is frequently asked by clients to help them prepare a legally sufficient Summary Plan Description (SPD) under the Employee Retirement Income and Security Act of 1974 (ERISA). ERISA requires that the sponsors of group health plans comply with certain disclosure requirements including the requirement to supply employees with an SPD. To be legally compliant with ERISA, an SPD must have certain statutorily defined specific information about the underlying plan that is specific to the employer and is not contained in the Certificate of Coverage supplied by SelectHealth. Thus, your SPD must include one or more documents you prepare and adopt in addition to the documents provided by SelectHealth; the documents supplied by SelectHealth are not a sufficient SPD.
Because employers must provide this specific information to their employees in order to comply with ERISA, the following sample “wrap” document is being provided to you by SelectHealth. When customized with your employer-specific information, and approved by your legal counsel, the resulting document could be used in conjunction with Certificate of Coverage, Member Payment Summary, and Provider & Facility Directory supplied by SelectHealth to create a Summary Plan Description. Please note that this is only a sample intended to be useful to SelectHealth customers generally, and should not be used “as is.” SelectHealth has not attempted to tailor the form in any way for your group. Thus, this document should not be used until it has been customized for your group and approved by your own attorney. The necessary information contained in the final document will vary depending on the specific design and administration of your plan (of which SelectHealth insurance is a part) and the existence of other plan documents.
Moreover, under ERISA the responsibility for issuing a Summary Plan Description rests with you, the Employer/Plan Administrator, and not with SelectHealth. SelectHealth is not the Plan Administrator and is not responsible for your compliance with ERISA. SelectHealth will not undertake to customize this form for you or file any documents that may be required from you by ERISA, and it makes no representations about the legal adequacy of this document in your specific circumstances. Please consult your own legal counsel.
You will notice bolded [brackets] throughout the sample document. This indicates where the plan-specific information can be added. A few brief explanations have been included in the Specific Plan Information portion of the document for better clarification.
If you have any questions, please contact your Account Coordinator or insurance Agent/Broker.
Thank you,
SelectHealth
\u000f[Name of Company]
[Name of Plan]
Summary Plan Description
[Effective Date]
\u000f
Introduction
[Name of Company] (the “Employer”) maintains the [Name of Plan] (“the Plan”) for the exclusive benefit of its eligible employees and their eligible dependents.
