We strongly encourage you to contact another Veterans Service Organization (VSO) if you need help with the stages of the process described below. We also encourage you to visit [https://www.va.gov/resources/the-pact-act-and-your-va-benefits/](https://www.va.gov/resources/the-pact-act-and-your-va-benefits/ for more)[ for more](https://www.va.gov/resources/the-pact-act-and-your-va-benefits/ for more) information about how the PACT Act may impact your eligibility for disability benefits. \nIf you apply for service connection for a medical condition you believe is related to exposure to burn pits fumes and the VA denies your claim, or if your condition is not one that has a presumption of service connection, you can apply for NVLSP to represent you. Please visit [https://www.nvlsp.org/what-we-do/burn-pits-claims-assistance-program/](https://www.nvlsp.org/what-we-do/burn-pits-claims-assistance-program/ for more)[ for more](https://www.nvlsp.org/what-we-do/burn-pits-claims-assistance-program/ for more) information about NVLSP’s Burn Pits Claims Assistance Program, and how to apply for NVLSP representation. \nHow do I prove I have a burn-pits related condition? \nWhen you apply for VA disability benefits, you normally have to show that your disability is “service connected.” That means you have to show this disability likely resulted from, or was aggravated by, something that occurred during your active duty service. If you can’t show this link to service with a VA or private medical opinion, the VA will usually deny your claim. \nFortunately, for some medical conditions, proving service connection is easy, because the condition qualifies for presumptive service connection. That means that, under the law, VA must presume your medical condition is related to your service if (1) you are diagnosed with one of the presumptive conditions and (2) you have a qualifying period of service. \nWhat medical conditions qualify for presumptive service connection? \nOn three occasion in recent years, a number of medical conditions have been designated as presumptively service connected for veterans with a qualifying period of service. First, in August 2022, the Sergeant First Class Heath Robinson Honoring Our Promise to Address Comprehensive Toxics (PACT) Act of 2022 became law. The law made many conditions presumptively service connected for veterans with a qualifying period of service. Those conditions are as follows: \n• Asthma \n• Chronic bronchiolitis or obliterative bronchiolitis \n• Chronic bronchitis \n• Chronic rhini","cbCaiuIfnr22Boey","https://ap.wps.com/l/cbCaiuIfnr22Boey","pdf",312416,7,"English","# Who is this guide for?\n## How do I prove I have a burn-pits related condition?\n## What medical conditions qualify for presumptive service connection?\n## What is a qualifying period of service?\n## What if my condition is not in the list above?","[{\"question\":\"Who should use this guide for an initial VA claim?\",\"answer\":\"This guide is for veterans seeking to apply for VA disability compensation for burn pit-related conditions when they have not previously filed a claim for service-connected disability compensation for those same conditions.\"},{\"question\":\"How does VA decide whether a burn pit-related disability is service connected?\",\"answer\":\"VA generally requires showing the disability resulted from or was aggravated by something during active duty service, and a VA or private medical opinion is often needed if the service connection link is not otherwise established.\"},{\"question\":\"Which conditions may qualify for presumptive service connection under the PACT Act and later VA updates?\",\"answer\":\"The guide lists presumptive conditions added through the PACT Act of 2022 (effective August 10, 2022), plus additional presumptions implemented on January 2, 2025 and January 10, 2025 for specified cancers and blood-related conditions.\"}]","Self-Help Guide for Filing an Initial VA Claim for Disability Benefits for Burn Pit-Related Conditions - Updated March 2025 | PDF"]
