To accomplish this goal, the policy outlines specific agency expectations for the professional and technical services vendor selection process. \nState agencies have a responsibility to conduct vendor selection evaluations in a manner consistent with state statute following the principles of fair and open competition. These principles include the following: \n• Fair and equal treatment of all vendors. \n• Advance disclosure of all mandatory requirements and selection criteria. \n• Selection of vendors based on best value. \n• Selection of vendors based on criteria and process as defined in the solicitation. \n• No organizational conflicts of interest on the part of the vendor unless acknowledged and waived by the Office of State Procurement (OSP) director. An organizational conflict of interest exists when, because of existing or planned activities or because of relationships with other persons, a vendor is unable to render impartial assistance to the State, the vendor’s objectivity may be impaired, or the vendor has an unfair competitive advantage. \nState agencies must ensure that state personnel conducting and participating in vendor selection evaluations are trained and able to follow statute and conduct the process following the principles of fair and open competition. \nAgency procurement and contracting staff are responsible for understanding and following this policy, completing training, and staying up to date on their understanding of the vendor selection process. \nAgency personnel participating in the vendor selection process are responsible for understanding and following this policy and attesting that their vendor selection process was ethical, fair and consistent with this policy and state statute. \nAgency leadership is responsible for ensuring there are personnel trained on vendor selection within their agency and that those trained personnel are involved in the vendor selection process. Agency leadership is responsible for ensuring corrective action is taken on policy noncompliance and reporting such failures to OSP. \nOSP is responsible for providing training on the vendor selection process at regular intervals and keeping the training refreshed, relevant and consistent with relevant vendor selection methods. OSP is responsible for answering vendor selection process questions in a timely manner and offering guidance on an as-needed basis. \nOSP is responsible for following up on any reported failures to follow this policy. OSP may take corrective actions, in addition to any agency corrective actions, for failures to follow this policy. \nApplication of Principles \nFair and Equal Treatment of All Vendors \nAgencies must ensure that agency personnel participating in the vendor selection process treat vendors fairly and commit to doing so. Agencies can both gauge ability and commitment by meeting with evaluation team members and ensuring they understand the OSP Evaluation Team Member Agreement, and what it means to give fair and equal treatment to all vendors. Evaluators show their commitment by signing the OSP Evaluation Team Member Agreement. Once scores from the evaluators score sheets are compiled, a final evaluation team meeting and review of the evaluation summary sheet can help ensure that vendors received fair and equal treatment. \nAdvance Disclosure of All Mandatory Requirements and Selection Criteria \nAgencies must list any requirements that would preclude a vendor from being selected. These requirements should be explicitly stated in the solicitation document (often listed as pass","cbCailz5KWhJ254X","https://ap.wps.com/l/cbCailz5KWhJ254X","pdf",236548,"English","# Policy Statement and Rationale\n## Fair and Open Competition Principles\n## Organizational Conflict of Interest\n## Training and Responsibilities\n# Application of Principles\n## Fair and Equal Treatment of All Vendors\n## Advance Disclosure of Mandatory Requirements and Selection Criteria\n## Selection of Vendors Based on Best Value","[{\"question\":\"What is the main purpose of OSP Policy 26-02?\",\"answer\":\"It ensures agencies conduct professional and technical services vendor selection fairly, ethically, and in compliance with state statutes, by defining specific expectations for the selection process.\"},{\"question\":\"What principles guide vendor selection under this policy?\",\"answer\":\"The policy requires fair and equal treatment, advance disclosure of mandatory requirements and selection criteria, and selection based on best value as defined in the solicitation.\"},{\"question\":\"How does the policy address organizational conflicts of interest?\",\"answer\":\"It states a vendor must not have an organizational conflict of interest unless it is acknowledged and waived by the OSP director, where the conflict can impair impartial assistance or create an unfair competitive advantage.\"}]","OSP Policy 26-02 - Professional and Technical Services Vendor Selection and Consideration of Best Value - Version 1.0 | PDF",1789187902]
