MOTION\n\nIn January 2012,the City Controller concluded an audit on the City's 20-year street furniturecontract with CBS Decaux. The audit found many issues that will result in the continuanceof a pattern that will result in substantially less revenue than projected to the City and feweramenities for transit riders such as shelters and restrooms. \nSpecifically,the audit determined that the City should have received $53 million in revenuewithin the first 10 years of the contract, but only received $29.9 million.Though there are manyreasons cited for this massive shortfall, including the City's own internal policies,it is evidentthat the City must to take immediate action to remedy the situation. \nIn March 2009,the City issued a \"breach of contract\"letter to CBS Decaux with regards tohow it affected the Minimum Annual Fee(MAF)due to the City;however, the City informallysuspended its pursuit of the matter pending the outcome of renewed talks to craft a contractamendment and to date it still has not been resolved. \nThe Controller's audit determines that if this issue is not resolved soon it would result in revenuelosses of more than $57 million to City moving forward.During these times when the City isfacing a $200 million budget shortfall, which is expected to grow to over $400 million in 2014,the City must take every action to ensure that we are protecting the City's and taxpayersrevenues and must pursue every option to protect these revenues. \nThe City Council recently requested that the Bureau of Street Services,Chief LegislativeAnalyst(CLA),and City Attorney review the current CBS Decaux contract and report to Council. Thus far, discussions with CBS Decaux have not yielded any substantial results. \nI THEREFORE MOVE that the City Council instruct the Bureau of Street Services,ChiefLegislative Analyst(CLA),and request City Attorney to provide regular updates to the PublicWorks Committee on the status of these negotiations on the next 10 years of the contract. \nIFURTHER MOVE that the City Council instruct the Bureau of Street Services,CityAdministrative Officer(CAO),Chief Legislative Analyst(CLA),and city agencies as needed,to report back to Council with suagested remedies to the revenue shortfalls embedded in thiscontract and a suggested accountability system to make sure that the contractor is meeting theircommitments during the years left on the contract. \nPresented by aelou tauJOE BUSCAINO n \nea \nAPR
