This MOU is between the Organization and the BOE and should be considered separate from the Zone application and each school’s Innovation plan.  \n1. Establishment: As authorized by the Innovation Schools Act of 2008, C. R.S. § 22-32.5-101 et seq. (the “Innovation Schools Act”), the District approved a Zone Application for the establishment of an Innovation Zone including the Beacon Zone Schools (the “Zone”) . As contemplated by the Beacon Zone Zone Application, the Board approves this MOU, upon the terms and conditions set forth in this MOU, as well as the terms and conditions outlined in the BOE Resolution \\#XX approving the Beacon Network Schools Innovation Zone Application (“Zone Application”) and the Zone Application. The approval and subsequent operation will be in alignment with Board Policy ADE,“Innovation in Education.” The Organization further acknowledges failure to meet the performance objectives outlined in this MOU or failure to adhere to the terms and conditions of this MOU, renders the Zone Application subject to revocation pursuant to the terms of this MOU and/or the Innovation Schools Act.  \n2. Mission: The Zone will empower Beacon Schools with collective flexibilities and resources; support for teachers and leaders to learn together, grow, and excel; and community ownership and involvement, in order to codify the Beacon Model and sustain it to improve outcomes for students.  \n3. Staffing  \na. Organization Personnel: Organization personnel are employees of the Organization not the District. All hiring, evaluation and dismissal decisions for Organization personnel will be made by the Organization.  \ni. The Organization agrees to obtain and retain copies of fingerprint and background checks for all Organization employees providing services or working with children at Beacon Zone Schools. The Organization shall give notice to the District of any employee or applicant it finds who has a prior conviction of any felony and/or misdemeanor involving moral turpitude and of any employee or applicant who is convicted of any felony and/or misdemeanor involving moral turpitude.  \nii. The Organization agrees to maintain all official personnel records for Organizational employees, including background checks and official  \ndocuments verifying the qualifications of personnel. The Organization agrees to make all personnel records promptly available to the District upon request.  \nb.  Beacon Zone Schools Personnel: Personnel at each Zone school are solely and exclusively employees of the District and are subject to all relevant District policies and practices that are not expressly waived in the Zone Application. All hiring, evaluation, promotion and dismissal decisions for employees of the District will be made according to the individual school Innovation Plans and District Policy.  \n1. The Beacon Zone shall select principals of IZ Schools and make decisions related to their retention and removal, subject to the Superintendent’s approval, which shall not be unreasonably withheld. Evaluations of school leaders in Beacon Zone Schools will be conducted by the Organization in accordance with the Zone Application and using LEAD.
