Dennis Park to a real estate development company, to develop the park into a mixed-use office and retail development. Opponents of the plan argued that a state statute, K.S.A. ß 12-1301, gives residents a right to petition to place the approval of the sale on the ballot. It was this attempt to have the issue placedon the ballot that led the City of Westwood to issue its threatening letter. \nToday, Kansas Justice Institute issued a rebuke to the City of Westwood, making clear that public comments and objections to the sale of the park are protected by the First Amendment to the United States Constitution and the Kansas Constitution. \n“It doesn’t matter what side of the debate you’re on, what matters is that you’re able to debate it without being threatened with a lawsuit by the government,” KJI litigation director Sam MacRoberts said. \n“The City of Westwood should immediately—and publicly—withdraw its threatening letter and affirm the right of the people to speak freely on matters of public concern,” \nMacRoberts continued. \nThis letter is part of KJI’s campaign against government interference with the free speech rights of Kansans. In 2019, KJI successfully sued the State of Kansas over its prohibition on truthful advertising by raw milk producers. \n\\#\\#\\# \nCONTACT: Ellen Hathaway, Communications Director of Kansas Policy Institute \n[ellen.hathaway@kansaspolicy.org](ellen.hathaway@kansaspolicy.org)","cbCaiptr28VR8FkC","https://ap.wps.com/l/cbCaiptr28VR8FkC","pdf",90654,"English","# First Amendment and the Cease-and-Desist Letter\n## Westwood’s Demands and Threatened Legal Claims\n## The Proposed Park Sale and Ballot Petition Dispute\n## KJI’s Response and Call for Withdrawal","[{\"question\":\"What letter does Kansas Justice Institute criticize, and who sent it?\",\"answer\":\"KJI criticizes a threatening cease-and-desist letter sent by the City of Westwood to opponents of the proposed development of a public park.\"},{\"question\":\"Why did the City of Westwood send the threatening letter?\",\"answer\":\"The letter followed opponents’ efforts to have the question placed on the ballot, based on a Kansas statute granting residents a right to petition for voter consideration of the sale approval.\"},{\"question\":\"What constitutional protections does KJI say apply to the public comments and objections?\",\"answer\":\"KJI states that public comments and objections are protected by the First Amendment to the U.S. Constitution and the Kansas Constitution.\"}]","Kansas Justice Institute Rebukes Westwood Over Threatening Cease-and-Desist Letter | PDF",1789483810]
