The change outlined in section 1.1 (b) will be mandatory from 1 March 2022. However, parties and practitioners are encouraged to comply with the change from the date of this Notice.
File inspections
Rule 28.05 now provides that a person who is not a party may not inspect or obtain a copy of the following documents without leave of the Court until the document has been tendered, read or otherwise relied on in the course of a hearing, or relied on in an application determined without a hearing:
affidavits;
exhibits to affidavits;
witness statements;
expert reports; and
written submissions, outlines of argument and chronologies.
The Access to Court Records form has been updated to reflect this change.
Filing of affidavits
From 1 March 2022 the Court will no longer accept affidavits for filing that:
include multiple exhibits; or
separate the affidavit from its exhibit (if any).
Solicitors must continue to submit their affidavits and exhibits via CITEC. If the document exceeds the current file size limit, please contact the CITEC Customer Service Centre who will attempt to reduce the size of the document. If this is not possible CITEC will send the document through to the Court for filing. Please note that the CITEC file size limit will soon be increased, and practitioners will be notified of this change.
Any affidavit that is filed with the Court must:
subject to section 3.4, include a maximum of one exhibit. If more than one document is referred to in the affidavit, the documents must be combined into a single ‘bundle exhibit’, ordered in the sequence they are referred to in the affidavit;
have legible page numbers at the bottom right-hand corner of each page that correspond with the digital display page numbers of the PDF that commence from the first page of the affidavit to the last page of the bundle exhibit;
subject to section 3.4, be in a single fully text-searchable PDF format file, including any bundle exhibit; and
electronically bookmark, in the pdf file, each referenced document in the exhibit with its short-form name (for example, ‘Contract dated 6 April 2020’).
Where any document referred to in an affidavit is claimed to be confidential, the affidavit may include an additional ‘confidential bundle exhibit’. Any such ‘confidential bundle exhibit’ should be submitted via CITEC as an electronic document separate from the electronic document containing the affidavit and main ‘bundle exhibit’. For more information on this please visit \u0013 HYPERLINK "https://www.countycourt.vic.gov.au/civil-efiling" \u0014Civil eFiling\u0015 on the County Court website.
An affidavit template is attached as an annexure to this notice and is available on the County Court website.
