Under the Immigration and Nationality Act (INA), U.S. citizens and Lawful Permanent Residents may petition for their foreign spouses and children. \nSection 216 of the INA was passed in 1986 to help deter fraud in marriage-based immigration applications and petitions. It sets forth a procedure for certain spouses and dependent children to remove the conditions placed upon their permanent resident status. While the process appears to be straight-forward, in meetings with the Ombudsman’s Office, stakeholders and USCIS officials identified numerous areas of concern. \nIndividuals filing Form I-751, Petition to Remove Conditions on Residence , often encounter difficulty due to lack of notice and inconsistent adjudications. These problems can result in undue burdens on spouses and children seeking immigration benefits and services, including the erroneous initiation of removal proceedings. U.S. Citizenship and Immigration Services (USCIS) has not made available to the public or incorporated into its Adjudicator’s Field Manual (AFM) comprehensive, up-to-date information on policies and procedures associated with Form I-751 adjudications. The agency has also not provided sufficient training for officers responsible for the application of INA section 216. \nThe following review evaluates the nature and extent of problems related to removal of conditions on residence for spouses and children, and presents recommendations to address them. We hope USCIS will seize this critical opportunity to implement necessary changes and renew its commitment to delivering exemplary service to deserving families. \nSincerely , \nMaria M. Odom \nCitizenship and Immigration Services Ombudsman \nRECOMMENDATIONS \n1. Provide Timely, Effective and Accurate Notice to Petitioner(s) and Their Attorneys or Accredited Representatives on I- 751 Receipt, Processing and Adjudication Requirements and Decisions; \n2. Ensure AFM Chapter 25 is Updated, Accurate and Complete, or Create a Superseding Source of Consolidated Information for I- \n751 Adjudications; and \n3. Train USCIS Staff to Apply the Updated AFM or Superseding Guidance with an Emphasis on Waiver Standards and Procedures. \nCitizenship and Immigration Services Ombudsman [www.dhs.gov/cisombudsman](www.dhs.gov/cisombudsman) \nCitizenship and Immigration Services Ombudsman \nImproving the Process for Removal of Conditions on Residence for Spouses and Children \nFebruary 28, 2013 \nThe Citizenship and Immigration Services Ombudsman, established by the Homeland Security Act of 2002, provides independent analysis of problems encountered by individuals and employers interacting with U.S. Citizenship and Immigration Services, and proposes changes to mitigate those problems. \nEXECUTIVE SUMMARY \nThis review by the Office of the Citizenship and Immigration Services Ombudsman (Ombudsman’s Office) considers U.S. Citizenship and Immigration Services’ (USCIS’s) application of section 216 of the Immigration and Nationality Act (INA), which imposes an initial two-year period of conditional residence on certain spouses and dependent children who obtain status based on a marriage to a U.S. citizen (USC) or lawful permanent resident (LPR) . It further establishes a detailed procedure for removing these conditions on status, which begins with the filing of a petition with fee, and extends through the appearance at any requested interview before USCIS ofthe petitioner(s) and/or derivatives. \nSince the enactment of INA section 216, the former Immigration and Naturalization Service (INS) and USCIS have issued more than a dozen guidance documents related to the processing of Form I-751, Petition to Re","cbCaiegnXCphx71E","https://ap.wps.com/l/cbCaiegnXCphx71E","pdf",837485,"English","# Executive Summary\n# Recommendations\n## Timely notice and clear decisions\n## Updated AFM Chapter 25 or consolidated guidance\n## Staff training on waiver standards and procedures\n# Methodology","[{\"question\":\"What problem does INA section 216 address in immigration cases?\",\"answer\":\"INA section 216 establishes a process for removing the two-year conditional residence status for certain spouses and dependent children after marriage-based immigration status is granted.\"},{\"question\":\"Why do petitioners and representatives face difficulties with Form I-751?\",\"answer\":\"They encounter barriers such as lack of timely notice and inconsistent adjudications, along with limited access to comprehensive, up-to-date policy and procedure information for Form I-751.\"},{\"question\":\"What recommendations does the Ombudsman’s Office make to USCIS?\",\"answer\":\"USCIS is urged to provide timely, effective, and accurate notice; update AFM Chapter 25 or create consolidated guidance; and train staff to apply updated guidance with emphasis on waiver standards and procedures.\"}]","Improving the Process for Removal of Conditions on Residence for Spouses and Children - Recommendations | PDF",1789300092,7]
