Although the operation of HOA’s is common and widespread, there is (oddly enough) no specific legislation which governs its existence. In October 2016 we saw the commencement of the Community Schemes Ombud Service Act which governs the relationship between homeowners and governing bodies of“community schemes” but this does not deal directly with the establishment or functions of Homeowner Associations. The Sectional Title Management Scheme Act which also commenced in 2016, deals with Sectional Titles, and not Homeowner Associations. What this therefore means, is that Homeowner Associations still remain an institution which isnot governed by any national legislation. What then does govern HOA’s? \nAn HOA is governed by its Constitution (which one could loosely compare the Conduct and Management Rules in a Sectional Title Scheme) . It is nothing more than a contract between the governing body made up of Trustees, and the various homeowners. The Constitution may restrict the homeowners in terms of what they are or are not able to do within the community and in respect of their property, and as such it is advisable that persons who will be purchasing within a community that is subject to a HOA, familiarize themselves with the Constitution’s stipulations. It may even include the payment of levies. The title deed of every property which forms part of the HOA will also contain a condition which stipulates that any registered owner of a property must form part of the HOA and that no registration can take place unless the HOA consents to the transfer. Each owner is obliged upon transfer to become a member of the HOA and in so doing, are bound by the Constitution/MOI of the HOA. \nThe only legislation we are aware of, which does specifically cater for HOAs is to be found in the Cape Town Municipal By-Law Act of 2015 (and which only applies to properties that fall within the Cape Town Municipal boundaries) . Upon the transfer of the first land unit, the HOA comes into existence. So, this happens by law. Magically, the HOA is born! In terms of this Act furthermore, once 60% of land units which comprise the HOA have been transferred, or within 2 years of the first transfer (whichever is the earlier date) the developer must call for a meeting to appoint Trustees. If this is not done, the developer is guilty of a criminal offence. The developer must then advise the City and provide a copy of the minutes of this first meeting. So far so good! \nA not too unfamiliar problem however, especially with smaller developments, is that HOA’s become defunct either due to the resignation of trustees or where trustees sell their properties and are never replaced. This means that the HOA stops functioning, with the consequence that there is nobody to sign off the consent required to transfer! What now? \n1. The Cape Town Municipal By Law Act states that the selling owner may then obtain 60% of the other owners’ consent to transfer (unless the constitution stipulates otherwise which is usually never the case) or, if this is not possible; \n2. You must follow the Constitution’s requirements to re-establish the HOA, should the Constitution have a clause that deals with this (once again, we don’t usually see such clauses) . \n3. If neither if these are options available to you, you can go through the very costly and time-consuming exercise of attempting to remove the condition in the title deed. \n4. And as a last resort, if this is also not an option, you can approach the High Court with an application to authorize the Registrar of Deeds to proceed with the transfer, without such a consent – hardly a commercially ","cbCailg5TXaO0QXr","https://ap.wps.com/l/cbCailg5TXaO0QXr","pdf",179093,"English","# Homeowners Association - A Few Things You Need to Know\n## How HOAs come into existence and what governs them\n## What happens when an HOA becomes defunct\n## Legal options to enable property transfer","[{\"question\":\"How does a Homeowners Association (HOA) come into existence?\",\"answer\":\"In Cape Town, the HOA is created by law upon the transfer of the first land unit.
