It sets approval conditions covering street frontage improvements, code compliance, building and fire requirements, and environmental safeguards including air quality permits, secondary containment, stormwater source control, and spill control planning.","# 0\n\nHearing Examiner's Reportand Findings  \nDATE:August 18,2020  \nAPPLICANT/OWNER NAME:Tributary Investments,LLC  \nMAILING ADDRESS:297 W.Hilton Dr.,Suite 1,St.George,UT 84770  \nREPRESENTATIVE:Wesley Stallings  \nMAILING ADDRESS:78S.Cleveland Ave.,Blackfoot,ID 83221  \nLOCATION OF REQUEST:2104 N.Main St,Pocatello,ID 83204  \nZONING:Light Industrial  \nLEGAL DESCRIPTION:legal description was submitted and reviewed  \nRequest:Tributary Investments,LLC,represented by Wesley Stallings of Stallings Chemical,hassubmitted an application for a conditional use permit to allow for heavy industrial use;morespecifically,the production of copper sulfate,in a light industrial zoning district.  \nPhysical characteristics of the site:The subject property is zoned Light Industrial (LI)and isapproximately 1.19 acres in size.The subject property is currently developed with an industrialstructure located at 2104 North Main Street.  \n## I.CONCLUSIONS AND CONDITIONS:\n\nBased on review of the Application for the conditional use permit,analysis of the staffreport,applicants'presentation,and no public comment,the Hearing Examiner approvesthe conditional use permit to allow for heavy industrial use,specifically theproduction of copper sulfate,in a light industrial zoning district,with the followingconditions:  \n1.Applicant shall work with City Engineering and Planning Departments to ensure that streetfrontage improvements are completed including sidewalk and landscaping requirements asoutlined in Pocatello Municipal Code Sections 12.04 and 17.05.250.  \n2.All applicable standards of the City of Pocatello Municipal Code Title 17 Zoning Regulationsnot herein listed and applicable shall apply.  \n3.All Building and Fire Code requirements shall be strictly adhered to.  \n4.Applicant shallprovide the City with a copy of any required air quality permits from theState of Idaho,or provide exemption paperwork.  \n5.In addition to any federal or state requirements,secondary containment shall be of a non-corrosive material and sized to 110%of tank volume.The tank shall be placed on animpervious surface that does not drain towards the storm drain system ora waterbody.Site must apply source control BMP's to prevent pollutant runoff to ground or street,perPortneuf Valley Stormwater Design Manual,Chapter 5.This includes a spill control plan todeal with sulfuric acid and copper sulfate,as well as any hazardous waste managementtriggers based on the concentration of these materials during a spill event.  \n6.Applicant shall provide the City with a copy on NOI and SWPPP or“no exposure”paperwork.  \n6.2  \n## II.    FINDINGS OFFACT\n\n1.The Hearing Examiner discloses that she visited the site to observe the physicalcharacter and relationships of the subject property and surrounding area.No ex-parte communications took place with anyone prior to the public hearing or duringthe writing of this report beyond the information gathered or requested at saidpublic hearing.The Hearing Examiner has no personal or professional interest thatwould not allow an impartial or unbiased decision.  \n2.A public hearing was held on Thursday August 13,2020 beginning at approximately  \n6:05 p.m.and closing at approximately 6:17 p.m.  \n## III.
