The letter explains why the child cannot attend an educational setting, cites relevant legal duties under the Chronically Sick and Disabled Persons Act 1970 and the Children Act 1989, and formally asks the local authority to assess needs and, if appropriate, provide weekly supermarket vouchers. It also requests acknowledgment of receipt and a response after assessment.","PRIVATE AND CONFIDENTIAL\n[Insert name and address of local authority. Some local authorities have a ‘school meals team’ which you can send this letter to. [Name of child] is in receipt of an Education Health and care Plan (“EHCP”) maintained by [name of local authority] which confirms that [he/she] receives a package of education otherwise than at school (“EOTAS”) [n.b. if EHCP does not confirm EOTAS package for any reason, explain that here but confirm that local authority is providing EOTAS package] as [he/she] is unable to attend an educational setting, due to [briefly describe the child’s needs here].\nCurrently, children who are in receipt of an EOTAS package are not entitled to free school lunches under the Education Act 1996. However, under section 2(4) of the Chronically Sick and Disabled Persons Act 1970 (“CSDPA 1970”), local authorities must make necessary arrangements to meet the needs of disabled children in their area, including by providing meals at home or elsewhere (Section 2(6)(g) CSDPA 1970). Therefore, if, following an assessment of need in accordance with section 17(1) of the Children Act 1989 and the ‘Working Together to Safeguard Children’ statutory guidance, it is identified that a child has a need for meals to be provided, then the local authority must provide them.\nI am writing to request that the local authority provides [name of child] with a weekly supermarket voucher to enable lunches to be purchased for [him/her]. I consider that providing supermarket vouchers in this way is necessary to meet [name of child]’s needs.
