With the ease of communication between workers outside of regular defined work hours and, employers having easy access to workers during their private time, an employee may feel the pressure to continue to work outside their regular hours.\nIt is important and imperative that organizations have proper policies and procedures in place to navigate the Ontario Provincial Government’s, The Working for Workers Act, 2021, which requires most employers to outline a “right to disconnect” for employees. The purpose of this document is to provide you with guidelines to create your own Disconnecting from Work Policy.\nThis policy guideline and template includes recommendations for inclusions; however, it can be customized for your organization. You simply download the template, customize it, and it’s ready to use.\nThis template was drafted by Whitten & Lublin Employment Lawyers in consultation with HRPA. It is intended to provide guidance and does not constitute legal advice. It is always recommended that you consult with your organization’s legal advisor(s) when interpreting and applying the law in your workplace.\nDisconnecting from Work Policy\nPrepared on [add date]\nContext\nEmployers that employ 25 or more employees on January 1 of any year must have a written Disconnecting from Work Policy in place by March 1 of that year. However, employers that meet the 25-employee threshold on January 1, have until June 2, to meet the new requirement to have a written Disconnecting from Work Policy in place.\nEmployers must provide a copy of the written Disconnecting from Work Policy that applies to a new employee within 30 days of the day the employee becomes an employee of the employer.\nEmployers must provide existing employees with a copy of the written Disconnecting from Work Policy to each employee within 30 days of preparing it or, if an existing Disconnecting from Work Policy is changed, within 30 days of the changes being made.\nFurthermore, as the Ontario Employment Standards Act, 2000 currently does not contain any specific rules or guidance for a Disconnecting from Work Policy required under the legislation, any aspect of this policy may be modified to suit the particular workplace.\nOverview\n[Employer name] (the “Company”) values the health and well-being of employees. Disconnecting from work at appropriate times is vital for a person’s well-being and sustaining a healthy work-life balance.
