Cortez held a hearing under Minnesota Statutes, section 256.045, subdivision 3.1  \nThe following people appeared at the hearing:  \n appellant;  \n appellant’s spouse;  \n EWS Appeals,  County.  \nThe Human Services Judge, based on the evidence in the record and considering the arguments of the parties, recommends the following Findings of Fact, Conclusions of Law, and  \nOrder.  \n1 The Minnesota Department of Human Services conducts state fair hearings pursuant to Minnesota Statutes, section 256.045, subdivision 3. The Department also conducts maltreatment and disqualification hearings on behalf of the Minnesota Departments of Health and Education pursuant to Minnesota Statutes, sections 626.556, subdivision 10i; and 626.557, subdivision 9d.  \nSTATEMENT OF ISSUES  \nThe issue raised in this appeal is:  \nWhether the agency’s determination to prorate appellant’s July 2019 Supplemental Nutrition Assistance Program benefits was proper.  \nRecommended Decision:  \nI recommend that the Commissioner of Human Services affirm the agency’s determination to prorate appellant’s July 2019 Supplemental Nutrition Assistance Program benefits.  \nPROCEDURAL HISTORY  \n1. On July 25, 2019,  County (agency) sent  (appellant) a written notice of action informing the appellant that her July 2019 Supplemental Nutrition Assistance Program (SNAP) benefit would be a prorated amount of $114.00 for July 25, 2019 through July 31, 2019. Exhibit A. On August 3, 2019, the appellant filed an appeal. Exhibit A.  \n2. On September 5, 2019, the Human Services Judge held an evidentiary hearing on the matter by telephone conference. The record was held open through September 13, 2019 for the appellant to submit a copy of documents alleged to have been submitted to the agency in May 2019, as well as for the agency to complete a document search for documents submitted by appellant on or around May 20, 2019. The documents from appellant were received on September 5, 2019 and the agency reported on September 9, 2019 that no documents were located in the document search. On September 13, 2019, the record closed consisting of the hearing testimony and four exhibits.2  \nFINDINGS OF FACT  \n1. Appellant’s SNAP case was due for recertification in July 2019. Exhibit 1. The agency mailed a Combined Six-Month Report (CSR) form in May 2019 and the completed form was required by June 16, 2019.  Testimony.  \n2 Exhibit A – Appeal Request with attachments; Exhibit B – Combined Six-Month Report form, dated May 20, 2019,  statement, 2018 federal tax return documents. 2019 federal estimated tax form, Notice of Late or Incomplete Report form dated June 16, 2019; Exhibit 1 – Appeal Summary with attachments; Exhibit 2 – Email from Agency dated September 9, 2019 reporting no documents were located in the document search.  \n2. The agency did not receive the completed CSR form from appellant and sent appellant a closure notice on June 16, 2019, informing appellant that her SNAP case was closing effective June 30, 2019 due to a late or incomplete report form.  Testimony and Exhibit B.  \n3. On June 30, 2019, appellant’s SNAP case closed.  Testimony.  \n4. On July 25, 2019,  submitted a completed CSR form at an in-office meeting with the agency. Exhibit 1. The agency completed the necessary verifications and reopened appellant’s SNAP case, effective July 25, 2019. Id.  \n5. The agency prorated appellant’s July 2019 SNAP benefit for the period July 25, 2019 through July 31, 2019, based on the date the agency received the completed CSR. Exhibit 1.
