The Pennsylvania Insurance Department (“Department”) finds true and correct each of the following Findings of Fact:  \n(a) Respondent is INSGROUP, LLC, and maintains a record of its address with the Pennsylvania Insurance Department as 5151 San Felipe, 24th Floor, Houston, TX 77056.  \n(b) Respondent is, and at all times relevant hereto has been, a licensed NonResident Surplus Lines Agency.  \n(c) Respondent, as a surplus lines agency, is required by statute to report premiums collected in both monthly reports (1620s) and an annual filing (RCT-123) to the Pennsylvania Surplus Lines Association.  \n(d) Respondent was notified by the Pennsylvania Surplus Lines Association by email on multiple occasions between 2020 and 2021 that it was noncompliant with its filing obligations.  \n(e) Respondent failed to comply with requirements identified in finding 3(c) by not filing the Pennsylvania state tax form RCT-123 for 2020, with the Pennsylvania Surplus Lines Association by February 1, 2021.  \nDocuSign Envelope ID: 53B093FD-A667-426B-8D31-1C03AAC0C30B  \nCONCLUSIONS OF LAW  \n4. In accord with the above Findings of Fact and applicable provisions of law, the Insurance Department concludes and finds the following Conclusions of Law:  \n(a) Respondent is subject to the jurisdiction of the Pennsylvania Insurance Department.  \n(b) 40 P.S. § 310.11(2) prohibits a licensee or an applicant from violating the insurance laws or regulations of this Commonwealth or a subpoena or order of the commissioner or of another state’s insurance commissioner.  \n(c) Respondent’s activities described above in paragraphs 3(d) and 3(e) violate 40 P.S. § 310.11(2) .  \n(d) 40 P.S. § 310.11(20) prohibits a licensee or an applicant from demonstrating a lack of general fitness, competence or reliability sufficient to satisfy the Department that the licensee is worthy of licensure.  \n(e) Respondent’s activities described in paragraphs 3(c) through 3(e) violate  \n40 P.S. § 310.11(20) .  \n(f) 40 P.S. § 991.1621 requires a tax of three percent to be levied against insureds on all premiums charge, and for that tax to be collected by the licensee and remitted to the Pennsylvania Department of Revenue.  \nDocuSign Envelope ID: 53B093FD-A667-426B-8D31-1C03AAC0C30B  \n(g) Respondent’s activities described in paragraph 3(e) constitute failure to collect and remit the required three percent surplus lines premium tax, and violate 40 P.
