The owner is the proprietor of the plant and equipment (“equipment”) listed in the schedule to this Agreement (“schedule”) .  \nR2 . Payment for rental  \nOn or before Commencement (or as otherwise specifically agreed with Dry Hire 4 U, the hirer will pay the Hire Charge.  \n2.1 the new list price of any Equipment which is for whatever reason not returned to Dry Hire 4 U.  \n2.2 all costs incurred in Excessive Cleaning of the Equipment or the cleaning fee as stipulated on the Hire Schedule;  \n2.3 the full cost of repairing any damage to the Equipment caused or contributed to by the hirer, unless expressly agreed otherwise in this Contract.  \n2.4 GST, any other taxes or duties, and all tolls, fines, penalties, levies or charges payable in respect of this Contract or arising from the hirer’s use of the Equipment.  \n2.5 all costs incurred by Dry Hire 4 U in recovering possession of the Equipment.  \n2.6 Interest for late payment of amounts owing by the hirer, at the pre-judgement interest rate set by the Local Court of NSW from time to time.  \n2.7 the Kilometre Charge.  \n2.8 the cost of fuels and consumables provided by Dry Hire 4 U and not returned by the hirer;  \n2.9 any reasonable expenses and legal costs (including commission payable to a commercial agent) incurred by Dry Hire 4 U in enforcing this Contract due to the hirers default.  \n2.10 all costs of repairing or replacing tyres, including road service.  \n2.11 if any damage and/or theft waiver applies, the amount for which the hirer is liable as set out in this Contract.  \n2.12 Loading costs when equipment hired with an hour meter is used in excess of 8 hours per day.  \n2.13 Hire fees for the period from the commencement of the hire until the Equipment is returned or a hirer pick up number is obtained from Dry Hire 4 U.  \n2.14 All non-recoverable costs incurred by Dry Hire 4 U in the provision of Equipment and/or services due to cancellation or postponement By the hirer.  \n2.15 If an excess is payable by the hirer a $1,000 .00 excess will apply.  \n3. Use, operation and maintenance  \nThe hirer agrees that the use of the equipment carries with it dangers and risks of injury and the hirer agrees to accept all dangers and risks.
