In no event, however, shall the CONSULTANT be considered an employee of the CITY. Accordingly, the CONSULTANT shall be responsible for the payment of all taxes arising out of his activities in accordance with this Agreement including, by way of illustration but not limitation, Federal income tax, Social Security tax, Unemployment Insurance taxes, and any other taxes or business license fees as may be lawfully required of a  \n2  \nCONSULTANT performing such services.
