The City owns and operates the Brooklyn Park Community Activity Center (“CAC”) which includes a  \n375 seat Grand Room dividable into three spaces seating 125 each, a Garden View Room with seating for 250 persons, one classroom and the Armory gymnasium with seating for 400 persons. The CAC has adjoining catering kitchens, patio area, and related amenities.  \n2. The CAC Community Rooms is marketed by the City to host meetings, business groups, weddings, special events, team parties, corporate gatherings, and other large community activities.  \n3. The City desires to have CATERER as one of five food and beverage caterers to perform the food and beverage and related catering services at the CAC. CATERER is willing and able to provide these services.  \n4. For purposes of this Agreement, a catered event is defined as an event where a contract for food or beverage catering services is executed between CATERER and a client. The CAC Manager will independently determine which events at the CAC will be catered.  \nFor in consideration of the mutual promises set forth herein, it is agreed by and between the City and CATERER as follows:  \nSECTION 1  \nREPRESENTATIONS  \n1. CATERER represents that it is a   duly organized, validly existing and in good standing with the State of   and that it has full power and authority to enter into this Agreement and to carry out the responsibilities required by the Agreement. CATERER further represents that its agents, representatives and employees have the necessary education, training, experience, certification, and licensing for purposes of servicing and performing this Agreement.  \n2.. The City represents that it is a municipal corporation and a political subdivision of the State of Minnesota and that it has full power and authority to enter into this Agreement.  \nSECTION 2  \nLOCATION OF SERVICES  \n1. CATERER services will be rendered at the Brooklyn Park Community Activity Center, which is located at 5600 85th Avenue North, Brooklyn Park, MN 55443.  \nSECTION 3  \nCATERER DUTIES AND RESPONSIBILITIES  \n1. CATERER shall obtain and maintain at its sole expense all licenses and insurance necessary to permit the sale of liquor, beer and wine in conjunction with CATERER-catered events at the CAC.  \n2. CATERER shall perform catering services at the CAC as follows:  \na. CATERER shall provide clients with price lists and menu selections to accommodate their needs for events held at the CAC that require food and beverage.  \nb. CATERER will provide one main contact person who agrees to meet with CAC staff in person at least once each week that the CATERER has a catered event at the CAC and contacts CAC staff by phone or e-mail at least once all other weeks.  \nc. CATERER agrees to meet with prospective CAC clients to provide information and agree upon menus and fees for particular events. CATERER shall return all prospective client and client phone calls and e-mail within one business day. Once a CAC client schedules an event with CATERER, CATERER shall notify the CAC Facilities Coordinator to inform the Coordinator of the date and time of the event and the facility to be scheduled.  \nd. CATERER shall be solely responsible for the recruitment, training, employment, performance, and compensation of adequate staff to meet the demand of the CAC client at each and every catered event, including, but not limited to, bartenders, servers, food preparers and hosts. This includes having a minimum of one catering staff person at the CAC during the entire event and after meal service to guarantee room cleanup and removal of catering supplies unless otherwise approved by the CAC Manager.  \ne.
