27-07-2026 | Abstract\u003Cbr>The development of science and technology has driven the transformation of the criminal evidence system from a conventional approach to the use of scientific evidence as the primary instrument in uncovering material truth. In this context, the involvement of forensic experts in the crime scene processing (TKP) stage is a determining factor in the quality of identification, security, and preservation of evidence from the beginning of the investigation. However, the Criminal Procedure Code (KUHAP) does not explicitly regulate the obligations, scope, or mechanisms for the involvement of forensic experts in the implementation of crime scene processing. This regulatory gap causes the use of forensic science to still depend on the discretion of investigators, thus potentially causing contamination, damage, or loss of evidentiary value of scientific evidence that ultimately affects the effectiveness of the criminal evidence process. This study aims to analyze the legal regulations regarding the involvement of forensic experts in crime scene processing, identify weaknesses in the existing regulations, and formulate an ideal regulatory concept as an effort to strengthen the criminal evidence system in Indonesia. The study uses a normative legal research method with a statutory, conceptual, case, and comparative approach. Primary, secondary, and tertiary legal materials were obtained through literature review and then analyzed qualitatively using grammatical, systematic, teleological, and comparative interpretation techniques. The results indicate that regulations regarding the involvement of forensic experts in criminal procedure law are still partial and do not integrate the function of forensic experts as part of the crime scene investigation process. The Criminal Procedure Code (KUHAP) only authorizes investigators to request expert testimony without establishing parameters regarding the timing of involvement, case classification, evidence handling standards, or chain of custody mechanisms. This situation has implications for the unenforced integrity of scientific evidence from the initial stages of the investigation. This study proposes a legal reform concept in the form of regulating the obligation to involve forensic experts in certain crimes requiring scientific evidence, establishing standards for crime scene investigation based on forensic science, strengthening the chain of custody principle, regulating coordination mechanisms between investigators and forensic experts, and utilizing digital technology in evidence management.
