No.15 \n## A Crucial Decision...\n\nSUPREME COURT SPEEDS UPDEATH PENALTY APPEAL PROCESS;ISSUES STREAMLINED PROCEDURES \nA new U.S.Supreme Court ruling gives deathpenalty states “a green light for speeding up execu-tions,\"but will not trigger immediate mass execu-tions of the nation's 1,202 condemned inmates, experts said on July 7. \nIts effects may be noticeable later as greaternumbers of murderers sentenced to die since 1976finally run out of ways to put off their executions. \nThe majority of death row prisoners have notyet reached the final stages of appeal. But an esti-mated 100 others have, and could find their livescut short by six months or more by the speedierprocedures condoned by the Supreme Court onJuly 6. \nThat speedup will \"slightly accelerate\"thelong-predicted \"resumption of executions in sub-stantial numbers,\"says Henry Schwarzschild ofthe American Civil Liberties Union(ACLU). \n\"But we've known that was coming anyway,\"Schwarzschild said.\"It's liable to come before theend of calendar ‘83.I wouldn't be surprised if wehad 10 or 12 before the year is out.\" \nOnly seven men have been put to death sincethe Supreme Court reinstated capital punishment in1976.A Justice Department agency predicted lastsummer the nation might witness as many as threeexecutions a week starting in 1983 or 1984(seerelated story“Number of Death Row Inmates...”on page 6). Corrections.Landon, formerly a deputy director, was appointed July 1 by Virginia Gov.Charles S.Robb to head the agency, which is responsible forthe confinement of nearly 10,000 adult prison in-mates and for the supervision of some 33,000 adultand juvenile offenders under probation, parole, orother correctional programsPrior to coming toVirginia,he was warden of the North Dakota StatePenitentiary for almost two years. He retired as acolonel in the U.S.Army Military Police Corps inJanuary,1973,after 23 years'military experiencein law enforcement, security, and corrections. \nUnder the Supreme Court ruling, issued July6 in the case of Texas death row inmate ThomasBarefoot, the onslaught of executions could begina little sooner than expected. \nFrom now on,when an execution date is setand imminent, the 12 U.S.Circuit Courts of Appealsmay step up the speed with which they handle afinal-hour appeal from a death row inmate. \nInstead of automatically postponing the execu-tion and taking the usual six months or longer toconsider an inmate's last-chance appeal,a Federalappeals court may use new streamlined proceduresto avoid delays in executions. \nIf they choose, the courts may compress thetime they usually take to consider a legal claim, hurriedly schedule arguments, issue a rejection andlet the execution take place on schedule. \nAlthough the ruling affects death penalty claimsonly when they reach the Federal appeals court, the results are crucial. The U.S.appeals courts aregenerally the next-to-last hope for inmates tryingto avoid execution. \n## \"Justice Will Be Carried Out\"\n\nAlan Dershowitz,a Harvard law professor who opposesuse of capital punishment in the U.S.said the ruling clearly“will be seen by state officials as a green light for speedingup executions.\" \nOfficials in the 37 states with death penalty laws onthe books generally agreed. \n“","cbCaidW4JFdXrUAh","https://ap.wps.com/l/cbCaidW4JFdXrUAh","pdf",2970343,11,"English","# A
