The nature of the tests varies across institutions, companies, climes and are determined by their presumptions of illnesses that may not be able to cope with the demands of work peculiar to the employment. Sometimes, the forms are loosely handed over to potential employees by unqualified staff, without due prior proper counselling sessions and the results or clinical report returned by the same potentially employable staff, who submit them in a pool with potential to breach confidentially. PEMEs are widely adopted across industries to assess applicants’ fitness for duty, workplace safety, and long-term health management. The practice of conducting pre-employment medical examination (PEME) is also prevalent in the Nigerian labour market. While PEMEs offer benefits such as prevention of occupational hazards, compliance with regulatory frameworks, and protection of public health, they also raise significant concerns regarding discrimination, privacy breaches, ethical conflicts, and questionable predictive validity. This paper provides a comprehensive and critical analysis of PEMEs, situating Nigerian practices within global medico-legal frameworks, including the Americans with Disabilities Act (ADA), the UK Equality Act, International Labour Organization (ILO) conventions, and World Health Organization (WHO) guidelines.
