No.48 \n# THE EMERGENCY FEDERALLAWENFORCEMENT ASSISTANCE PROGRAM\n\nThe Federal Government administers a varie-ty of assistance programs to provide a coordinatedresponse to state and local governments stricken bynatural disasters.During such extraordinarycircumstances, when state or local agencies areincapable of unilaterally coping with the aftermathof a flood, hurricane, tornado,or other naturalcalamity, the Federal Government has come totheir aid with a multi-agency response. \nAlthough the Federal Government has pro-grams to assist state and local governments withnatural disasters, until 1984 there was no coordi-nated Federal response for any other type ofemergency.A number of events occurring in thelate 1970s and early 1980s are examples of thetypes of unexpected law enforcement emergenciesstate and local agencies may face:the Atlanta childmurders;the Los Angeles Night Stalker,SanFrancisco Zodiac, and Seattle Green River serialmurder investigations;and the Mariel Cuban boat-lift.Although the Federal Government's primarylaw enforcement role is to enforce Federal criminalstatutes,it can play an ancillary role by assistingstate and local governments with unexpected lawenforcement emergencies that overwhelm theircapacities to respond. \n# Program Scope And Purpose\n\nOn Oct.12,1984,the Emergency FederalLaw Enforcement Assistance (EFLEA)Programwas enacted into law as part of the JusticeAssistance Act of 1984(Public Law 98-473)and isnow administered by the Bureau of Justice Assist-ance(BJA),Office of Justice Programs(OJP),U.S.Department of funds, equipment, training, intelligence information, and personnel to helpalleviate emergency situations. It also authorizesthe director of BJA to assist the Attorney Generalin providing EFLEA assistance and coordinatingprogram activities. \nCongress'intent in passing the EFLEAProgram was to create an assistance program toaddress extraordinary circumstances that have thepotential to create serious threats to public safety.Congress limited the number of eligible law en-forcement emergencies by restricting applicabilityto situations in which state and local resources havebeen completely exhausted or are inadequate todeal with a law enforcement emergency. \nThe legislative history of the Justice Assist-ance Act of 1984 indicates that Congress expectedfew emergencies to be dire enough to requireFederal involvement through EFLEA.The pro-gram was never intended to be a routine source ofFederal financial
