Examples 2, 4 and 5 inSection (V) of the supplemental guidance published in the Federal Register did not reproducecertain formatting (i.e. , underlining and strikethrough) in the text that is necessary tounderstand the examples. See Supplemental Guidance for Examination of Design PatentApplications Related to Computer-Generated Electronic Images, Including Computer-Generated Icons and Graphical User Interfaces, 89 FR 5506 (January 29, 2024) . Thefollowing examples contain the proper formatting. \nExample 1 \nAs presented, the claimed design in this example complies with 35 U.S.C. 171 because: \n(1) the USPTO considers a computer icon or a GUI on a display panel to be anintegral and active component in the operation of a programmed computerdisplaying the design and more than a displayed picture; and \n(2) the application fully discloses the design as embodied in an article ofmanufacture, as the drawing depicts the design embodied in a computer screen in \nbroken lines. \nIn addition, the title and claim comply with 37 CFR 1.153(a) because the title and claimadequately designate a particular article of manufacture (i.e., the computer displayscreen) . \nAs presented, the title and claim should be objected to under 37 CFR 1.153(a) for failingto designate a particular article of manufacture. However, as presented, the claimeddesign in this example does comply with 35 U.S.C. 171 because: \n(1) the USPTO considers a computer icon or a GUI on a display panel to be anintegral and active component in the operation of a programmed computerdisplaying the design and more than a displayed picture; and \n(2) the application fully discloses the design as embodied in an article ofmanufacture, as the drawing depicts the design embodied in a computer display \nscreen in broken lines and the description (i.e., the broken line statement)describes a portion of a computer display screen. \nTo address the objections to the title and claim, the application could be amended as \nfollows: \nThe objections should be maintained until the title andthe claim are appropriately \namended. \nAs presented, the claimed design in this example does not comply with 35 U.S.C. 171.The image is merely a picture displayed on a computer display screen . Because theoriginal disclosure does not provide support for amending the claim to include acomputer icon, the claim is fatally defective under 35 U.S.C. 171 and should be rejectedunder 35 U.S.C. 171, as set forth in MPEP section 1504.01(a), subsection (I)(B) . Inaddition, the title and claim should be objected to under 37 CFR 1.153(a) for failing todesignate a particular article of manufacture. \nAs presented, the claimed design in this example would not comply with 35 U.S.C. 171because the drawing does not depict an article of manufacture (e.g., a display panel) ineither solid or broken lines. Therefore, the claim should be rejected under 35 U.S.C. 171,as set forth in MPEP section 1504.01(a), subsection (I)(B) . In addition, the title and claimshould be objected to under 37 CFR 1.153(a) for failing to designate a particular article ofmanufacture. Specifically, the language “for use on a mobile device screen” does notadequately designate a particular article of manufacture. However, because the originaldisclosure provides support for a mobile device screen, the application could be amended \nas follows: \nNote that a replacement figure showing the portion of a mobile device screen in eithersolid or broken lines must not introduce new ","cbCaiuBQsU9klVgT","https://ap.wps.com/l/cbCaiuBQsU9klVgT","pdf",310980,"English","# Supplemental Guidance for Examination of Design Patent Applications Related to Computer-Generated Electronic Images, Including Computer-Generated Icons and Graphical User Interfaces\n## Compliance with 35 U.S.C. 171 in the Provided Examples\n## Objections under 37 CFR 1.153(a) and Article of Manufacture Requirements\n## Amendment Approaches and Replacement Figure Guidance","[{\"question\":\"What is the purpose of the supplemental guidance for these design patent applications?\",\"answer\":\"It provides examination guidance and clarifies how the USPTO evaluates examples involving computer-generated electronic images, including icons and graphical user interfaces.\"},{\"question\":\"How do the examples address compliance with 35 U.S.C. 171?\",\"answer\":\"The examples discuss when a computer icon or GUI on a display panel can be treated as an integral and active component, and when the application fully discloses the design as embodied in an article of manufacture.\"},{\"question\":\"What objections are considered under 37 CFR 1.153(a), and what do they require?\",\"answer\":\"The guidance addresses objections when the title and claim fail to adequately designate a particular article of manufacture, and it explains amendment possibilities when the original disclosure provides support.\"}]","Supplemental Guidance for Examination of Design Patent Applications Related to Computer-Generated Electronic Images - Examples | PDF",23]
