REASON FOR ISSUE: This Veterans Health Administration (VHA) directive establishes the Privacy Compliance and Accountability Program and the required activities and procedures to conduct continuous readiness review and remediation (C3R) and validate VHA compliance with Federal privacy laws, Department of Veterans Affairs (VA) and VHA privacy and records management policies, the Freedom of Information Act (FOIA), and National Archives and Records Administration (NARA) regulations at 36 C. F. R. Chapter XII Subchapter B – “Records Management”. Compliance review and auditing of the records management program and practices is required by NARA.  \n2. SUMMARY OF CONTENTS:  \na. This amendment dated November 21, 2023 updates language in Appendix D on employee health records.  \nb. This amendment dated November 16, 2022, updates the directive title; removes the VA Health Care Facility FOIA Facility Self Assessment paragraph; adds FOIA and records management to Health Care Facility Privacy Self Assessments (paragraph 14); replaces the title of Director, National Data Systems Health Information Access with Business Associate Coordinator; and adds Appendix F. NOTE: This amendment incorporates policy on C3R activities for privacy, FOIA and records management. VHA Directive 6300. 01(3), Records Management Continuous Readiness Review and Remediation, dated August 17, 2017, is now rescinded via VHA Notice 2022-14, Rescission of VHA Directive 6300. 01(3), Records Management Continuous Readiness Review and Remediation, dated November 16, 2022.  \nc. This amendment dated November 20, 2020, adds a paragraph to Appendix D, paragraph 1. b. (4) about Transporting Federal Records.  \nd. This directive includes changes to procedures necessary to conduct auditing and C3R to ensure compliance with all applicable Federal privacy and to evaluate VHA's implementation of its privacy, FOIA, and records management practices. This directive also includes a terminology change from “monitoring” to “continuous readiness review and remediation”(C3R) or “review”, to better align with the National Institute of Standards and Technology (NIST) language as applied to NIST privacy standards.  \n3.
