It covers how claims and descriptions function across prosecution and enforcement, timelines for non-final and final refusal notices, and the basic flows from filing through examination, applicant responses, grants or refusals, and appeals. Advice sections address country-specific handling for practitioners.","PATENT PROSECUTION GUIDEBOOK in Japan  \n4th edition – April2023  \nYasunobu Yamauchi Shin Yamauchi  \nINTRODUCTION  \nThe main purpose of this guidebook is to provide patent practitioners in countries outside of Japan a simple explanation of procedures for obtaining Japanese patents.  \nThe procedures for obtaining patents in Japan include procedures that can be dealt with substantially the same as those of the procedures in the United States and the EPO and procedures different from them.  \nFirst, the roles of the claims and description are common. The claims and description have crucially significant roles in patent systems. For example, in the patent prosecution phase, an amendment to overcome reasons for refusal must be done within the scope of matters stated in an originally-filed description and the like. In the rights enforcement phase, the applicant's allegations and advantageous evidence are limited to the scope of the matters described in the description and the like.  \nFurther, notices of reasons for refusal are usually issued up to two times, the first (which is also referred as \"non-final\") notice of reasons for refusal and the final notice of reasons for refusal, similarly to the U.S. practice. However, the Japanese procedure is different from the U.S. procedure in various points.  \nThis guidebook shows basic flows of patent prosecution in the Japan Patent Office. We also point out how to deal with the prosecution for patent practitioners in various countries including the U.S. and EPO members in the \"ADVICE\" sections as far as possible.  \nWe hope that this guidebook will be useful for patent practitioners in the various countries when they file a patent application in Japan.  \nTABLE OF CONTENTS  \nChapter 1 Patent Application ......................................................................................... 3  \n[1] Significance of Patent Application ......................................................................... 3  \n[2] Route and Language of Patent Application ............................................................ 3  \n[3] Procedures for Patent Application .......................................................................... 6  \nChapter 2 Preparation of Application Documents......................................................... 8  \n[1] Matters to be Stated in Request .............................................................................. 8  \n[2] Matters to be Stated in Claims ................................................................................ 9  \n[3] Requirements of Unity of Invention ..................................................................... 10  \n[4] Matters to be Stated in Description....................................................................... 12  \nChapter 3 Acceptance of Patent Application to Request for Examination of Application ..................................................................................................................... 17  \n[1] Acceptance of Application .................................................................................... 17  \n[2] Laying Open of Application.................................................................................. 17  \n[3] Request for Examination of Application .............................................................. 18  \nChapter 4 Examination of Patent Application ............................................................. 20  \n[1] Substantive Examination System.......................................................................... 20  \n[2] Flows of Examination Procedures, etc................................................................. 21  \nChapter 5 Proceeding of Response by Applicant in Examination............................... 23  \n[1] Examination by Japan Patent Office ..................................................................... 23  \n[2] Response to First Notice of Reasons for Refusal by Applicant ............................ 25  \n[3] Response to ","cbCaibFYi4PWpvkD","https://ap.wps.com/l/cbCaibFYi4PWpvkD","pdf",1119141,38,"English","en",105,"# Introduction\n# Chapter 1 Patent Application\n## Significance of Patent Application\n## Route and Language of Patent Application\n# Chapter 2 Preparation of Application Documents\n## Matters to be Stated in Request\n## Matters to be Stated in Claims\n## Requirements of Unity of Invention\n## Matters to be Stated in Description\n# Chapter 3 Acceptance of Patent Application to Request for Examination of Application\n## Acceptance of Application\n## Laying Open of Application\n## Request for Examination of Application\n# Chapter 4 Examination of Patent Application\n## Substantive Examination System\n## Flows of Examination Procedures, etc.\n# Chapter 5 Proceeding of Response by Applicant in Examination\n## Examination by Japan Patent Office\n## Response to First Notice of Reasons for Refusal by Applicant\n## Response to Final Notice of Reasons for Refusal by Applicant\n## Decision to Grant Patent and Decision of Refusal\n## Registration of Establishment\n# Chapter 6 Procedures for Appealing against Refusal after Examination\n## Appeal against Decision of Refusal\n## Procedure for Appeal against Examiner's Decision of Refusal\n# Chapter 7 Procedures for Appealing against Refusal after Appeal\n## Appeal against Appeal Decision of Refusal\n## Procedure for Litigation Rescinding Appeal Decision","[{\"question\":\"What is the main purpose of this guidebook?\",\"answer\":\"It provides patent practitioners in countries outside Japan with a simple explanation of procedures for obtaining Japanese patents, including how Japanese practice differs from and overlaps with the U.S. and EPO.\"},{\"question\":\"How do claims and the description function in Japanese patent prosecution?\",\"answer\":\"Claims and the description have crucial roles;
