 \n1  \nEACE FREED0  \nDEMORACyGROWSTOPM(ROW  \n●UR GENERATINWILL·NoT  \nBE SILENT  \nSTATEMENT OF THE LABOR YOUTH LEAGUEIN ANSWER TO THE ATTORNEY GENERAL’SCHARGES UNDER THE MeCARRAN ACT  \nmHIS pamphlet contains the statement of theNational Council of the Labor Youth Leaguein answer to the Attorney General's charges underthe notorious MeCarran Act.  \nOn April 23,the Attorney General petitioned the“Subversive Activities Control Board”for an orderaimed at banning the Labor Youth League andeleven other organizations as being what the Mc-Carran Act calls“Communist-front organizations.”  \nThese unprecedented actions were undertaken de-spite the fact that the challenged constitutionalityof the Act has not been ruled upon by the courts.  \nNow in fact,after this pamphlet had gone to theprinter,the Attorney General has had to amendthe petition against one of the twelve organizations.He has been forced to admit that his effort to basethe new cases on the prior MeCarran Board\"rul-ing”against .the Communist Party is fraudulent.We made this very point in paragraph 7 of theIntroduction of our statement,as one of the manyevidences of the lawless character of these proceed-ings.There is no constitutional way to apply theunconstitutional McCarran Act.  \nAn injunction is being sought in the courts tohalt altogether the proceedings against the twelveorganizations.If they continue,however,this state-ment along with other legal documents will be pre-sented to the McCarran Board as the Labor YouthLeague's formal Answer to the petititon against it.  \n# INTRODUCTION\n\nThis proceeding is designed to illegalize the Labor Youth League,to imprison its leaders and place the brand of outlawry on its viewsand policies.  \nNever in our land since King George III vainly proscribed theSons and Daughters of Liberty has the power of government beenset in motion to stamp an organization of young people as a criminalassociation.  \nTo accomplish this despotic purpose the Attorney Generalutilizes those sections of the unconstitutional McCarran\"InternalSecurity”Act which the President of the United States in his vetomessage singled out as\"the greatest danger to freedom of speech,press and assembly since the Alien and Sedition Laws of 1798.”  \nBut not even under the Tory laws of the eighteenth century wasthere an attempt to imprison American young people for being electedleaders of a youth organization advocating“forbidden ideas.”  \nOnly in the political climate of McCarthyism has that Americandemocratic tradition which treasures youth's right of inquiry,itsright to question and challenge,been threatened with complete de-struction.  \nThe McCarran Act is the statutory embodiment of McCarthyism.It is based on the dragnet doctrines of“guilt by association”and\"parallelism.\"It attempts to outlaw first the Communist Party,asthe basis for then destroying all organizations through which thepeople might express their aspirations for peace,democracy,andsocial progress.Although without precedent in republican America,  \nthe Act carefully follows the pattern of repression made familiar inHitler Germany and Franco Spain.  \nIts victims are condemned in advance by a verdict written intothe Act itself.It substitutes McCarran-invented\"findings\"in placeof the necessity for proof,in place of evidence which does not exist.The first step was the predetermined \"ruling\"on April 20 by the Sub-versive Activities Control Board against the Communist Party.Despitethe fact that the “ruling”is being appealed to the courts and has nolegal force,action was immediately begun against the Labor YouthLeague and eleven other groups as so-called“Communist-front or-ganizations.\"And the Attorney General has calmly announced thatmore than 240 additional organizations are on his initial McCarranwaiting list!
