Provides detailed definitions for key terms including abandoned vehicles, disposal, enforcement officer, free piles, hazardous waste, highway, junk, and related motor-vehicle terminology.","C  \nJ  \nTown of Wolcott,Vermont  \n# ORDINANCE REGULATING THE DISPOSAL OF SOLID WASTEAND THE OUTDOOR STORAGE OF JUNK AND JUNK VEHICLES\n\n## SECTION1.Authority\n\nThis ordinance is enacted pursuant to the authority granted to the Town of Wolcott(\"Town\")toadopt,amend,repeal,and enforce ordinances by 24V.S.A.§§1971et seq.;to promote the publichealth,safety,and welfare,to regulate or prohibit the storage or dumping of solid waste,and tocompel the cleaning of any premises in which the judgment of the legislative body is dangerousto the health and safety of the public by 24V.S.A.§2291(12),(13),(14);the power to prohibitthe throwing,depositing,burning,and dumping of refuse by 24 V.S.A.§2201(b);the power tomanage and regulate solid waste disposal within its boundaries by 24V.S.A.§2202a;the powerto enforce a solid waste ordinance by 24V.S.A.§52297 et seq.;the power to regulate abandonedmotor vehicles under 23 V.S.A.§2157;to regulate salvage yards under 24V.S.A.§2246;and thepower to provide for penalties for violations of any ordinance adopted by 24 V.S.A.§2291(15).  \nThis ordinance shall be a civil ordinance within the meaning of 24 V.S.A.chapter 59.  \n## SECTION 2.Purpose\n\nIt is the purpose of this ordinance to regulate the disposal of solid waste,the location and outdoorstorage of junk,junk vehicles,abandoned motor vehicles,and salvage yards in the Town in orderto protect the public health,safety,and well-being of the public and to protect the environment.  \n## SECTION 3.Definitions\n\nFor purposes of this ordinance,the following words and/or phrases shallapply:  \na.\"Abandoned vehicle\"means a motor vehicle that has remained on public or private property oron or along a highway without the consent of the owner or person in control of the property formore than 48 hours,and has a valid registration plate or public vehicle identification numberwhich has not been removed,destroyed,or altered;or a motor vehicle that has remained onpublic or private property or on or along a highway without the consent of the owner or personin control of the property for any period of time if the vehicles does not have a valid registrationplate or the public vehicle identification number has been removed,destroyed,or altered.  \nb.“Abutting property owner”means any person or persons that owns,leases,or in any other wayuses or controls the real property abutting any portion of the property of another.  \nc.\"Disposal\"shall mean the discharge,deposit,injection,dumping,spilling,leaking,or placing ofany solid waste or hazardous waste into or on any land or water so that such solid waste orhazardous waste or any constituent thereof may enter the environment or be emitted into theair or discharged into any ground or surface waters.  \n.  \nd.“Enforcement Officer”means any person appointed by the Wolcott Selectboard(“Selectboard”)to enforce the provisions of this ordinance.  \ne.“Free pile”means household goods placed on the owner's property that are made available forfree to the public for pickup and are accompanied by signage identifying them as free.Free pilesmay be left outside of a suitable,enclosed waste container for no more than 72 hours.Householdgoods include furniture,tires,clothing,personal belongings,toys,bicycles,dishware,and lawnequipment.  \nf.\"Hazardous waste\"shall mean any waste or combination of wastes of a solid,liquid,containedgaseous,or semi-solid form,including those which are toxic,corrosive,ignitable,reactive,strongsensitizers,or which generate pressure through decomposition,heat,or other means,which inthe judgment of the Secretary may cause,or contribute to,an increase in mortality or an increasein serious irreversible or incapacitating reversible illness,taking into account the toxicity of suchwaste,its persistence and degradability in nature,and its potential for assimilation,orconcentration in tissue,and other factors that may otherwise cause or contribute to adverseacute or chronic effects on the health of persons or other living organisms,or any m","cbCaiiipi9LmTpil","https://ap.wps.com/l/cbCaiiipi9LmTpil","pdf",4171368,1,"English","en",105,"# Section 1.
