No.21 \n# NEW CRIME LAW LIMTTSPOWER OF FEDERAL COURTSTO ADMINISTER STATE PRISONS\n\nProvision Deals Unexpected Blowto Early Releases,Early Parole \nLargely unnoticed in the crime bill PresidentClinton signed into law last month is an amendmentthat limits the power of Federal courts to imposepopulation czps on stzte and local prisons andprohibits prisoners from using cass-action suitsagainst state prisons to alleviate alleged overcrowd-ing.In so doing,Heritage Foundation state policyanalysts Wesley Smith and Douglas Seay say, theprovision could prevent many of the early releaseand early parole decisions that have allowed con-victed felons back onto America's streets. \nIn a paper released Oct.10 by the HeritageGovernors'Forum,Smith and Seay point out thatthe amendment, sponsored by Rep.Charles Canady(R-Fla.)and Rep.Pete Geren(D-Texas),\"requiresthat individual plaintiffs demonstrate that they havesuffered actual harm from overcrowding before thecourts can use that rationale as a basis for imposing'population caps'and other remedies that result inearly release and parole.\" \nAlso,the provision prevents Federal judgesfrom imposing such caps \"unless it can be shownthat crowding is inflicting cruel and unusual pun-ishment on particular, identified prisoners.\" \nPreviously,no harmful impact on any indi-vidual prisoner needed to be demonstrated;anyjudge, pursuant to unwritten standards, coulddetermine that such harm was being inflicted on theprison population in general, the analysts say.Furthermore, activist attorneys could \nU.S.District Judge Edward W.Nottinghamtwo weeks ago based his decision on First Amend-ment concerns. The prison's effort to keep inmateRobert James Howard Jr.from performing hisrituals \"appears to have been based on the contentof plaintiff's beliefs--an unacceptable criteriaaccording to the Supreme Court,\"the judge wrote. \nThe rituals Howard wants to perform do notinvolve bloodletting or violence, the judge noted. He added that Howard is asking for \"the sameprivileges granted to every other religious group.\" \nSee SATANIC RITUALS,page four) \nCORRECTIONS DIGEST \nCRIME LAW,from and states to release prisoners early withoutever investigating whether alleged abuses were infact occurring or whether a population cap orforced release would actually remedy the problem,\"the analysts say.The result is that today,39 statesand 300 of the nation's largest jails operate undersome form of Federal court direction.And,\"almost one-third of violent crimes now are com-mitted by people on pretrial release, probation orparole.By the mid-1980s,violent criminals onaverage were spending less than a third of theirsentences behind bars.\" \nThe Canady-Geren amendment is \"an
