The infographic contrasts myths with facts, noting police generally cannot stop drivers without cause, while approved screening allows demands for a breath sample in specific circumstances. It outlines the lawful stop and care-and-control requirements, highlights a BAC 80 mg threshold within two hours of driving, and describes limited defenses. It also warns that impairment can occur well before 80 mg and emphasizes driving safely by not drinking.",{"@graph":69,"@context":122},[70,84,105],{"@type":71,"itemListElement":72},"BreadcrumbList",[73,77,79,82],{"item":74,"name":75,"@type":76,"position":8},"https://docshare.wps.com","Home","ListItem",{"item":78,"name":9,"@type":76,"position":14},"https://docshare.wps.com/document/",{"item":80,"name":35,"@type":76,"position":81},"https://docshare.wps.com/document/healthcare/",3,{"item":83,"name":65,"@type":76,"position":19},"https://docshare.wps.com/document/new-alcohol-impaired-driving-laws-what-do-they-mean/296496/",{"url":83,"name":65,"@type":85,"image":86,"author":91,"headline":65,"publisher":94,"fileFormat":97,"inLanguage":63,"description":67,"dateModified":98,"datePublished":99,"encodingFormat":97,"isAccessibleForFree":100,"interactionStatistic":101},"DigitalDocument",{"url":87,"@type":88,"width":89,"height":90},"https://docshare.wps.com/thumbnails/new-alcohol-impaired-driving-laws-what-do-they-mean/296496.png","ImageObject",300,407,{"name":92,"@type":93},"Maeve","Person",{"url":74,"name":95,"@type":96},"DocShare","Organization","application/pdf","2026-10-22","2026-09-18",true,{"@type":102,"interactionType":103,"userInteractionCount":29},"InteractionCounter",{"@type":104},"ViewAction",{"@type":106,"mainEntity":107},"FAQPage",[108,114,118],{"name":109,"@type":110,"acceptedAnswer":111},"When can police use mandatory alcohol screening?","Question",{"text":112,"@type":113},"Mandatory alcohol screening can be used only if you are in care and control of the vehicle, you have been lawfully stopped, and the police officer has the approved screening device available. In 2017, there were more than 69,000 impaired driving incidents reported by the police, including almost 3,500 drug-impaired driving incidents. In December 2018, new impaired driving laws came into effect to make our roads safer and to save lives. \nMYTH: FACT: \nMandatory alcohol screening permits police to demand a breath sample from people in their homes or bars. \nPolice cannot stop you while driving unless you have done something wrong. \nPolice can use mandatory alcohol screening to come to your house two hours after you arrive home and demand a breath sample. \nYou can beat an “at or over 80 mg”charge if you have several drinks right before driving, because the alcohol didn’t affect you until after you drove. \nYou can beat a charge of “at or over 80 mg” if you drink after being stopped by the police. \nMandatory alcohol screening can only be used if you, as the driver, are in care and control of the vehicle, have been lawfully stopped, and if the police officer has the approved screening device at hand. \nPolice have long had the power to stop drivers to check to see if they have a valid licence, if they are sober, and if their vehicle is roadworthy. They don’t need to see you do anything wrong. \nFor mandatory alcohol screening to be used: The car must be lawfully stopped \nYou, as the driver, must be in care and control of the vehicle The police officer must have the device at hand \nThe new law covers this situation and you can be convicted if you have a blood alcohol concentration (BAC) at or over 80 mg within two hours of driving. This change was made to address this type of risky and dangerous behaviour on our roads. \nThis defence now only applies if: A driver drank after driving \nThere was no reason to think they would need to provide \na sample (e.g. , they were not involved in an accident) The breath results indicate they were under a blood alcohol concentration of 80 mg while driving \nIf you are under 80 mg of blood alcohol concentration, you are safe to drive. \nMany individuals are impaired long before they reach a blood alcohol concentration of 80 mg. You can still be charged with impaired driving, and you may face serious provincial consequences, like losing your licence. \nThe best practice is not to drink and drive. \nThe two hour window aims to prevent risky and dangerous behavior that decreases road safety by eliminating the“bolus drinking” defence and limiting the “intervening drinking” defence. \nFor example: \nIn a “bolus drinking” defence, a driver would admit that their BAC was at or over 80 mg at the time of testing but claim it was not at the time of driving because they consumed a significant amount of alcohol just before or while driving, arguing that the alcohol was still being absorbed and, not at or over 80. \nIn an “intervening drink” defence, a driver claims to have consumed alcohol after operating the vehicle but before testing, often used after an accident where the driver claimed they drank to calm their nerves. This defence made it difficult for law enforcement to determine the actual BAC at the time of driving.","cbCaiboecRgOoEdv","https://ap.wps.com/l/cbCaiboecRgOoEdv","pdf",999101,"English","# NEW ALCOHOL-IMPAIRED DRIVING LAWS\n## What do they mean?\n## Myth: Fact\n## When mandatory screening can be used\n## BAC thresholds and defenses","[{\"question\":\"When can police use mandatory alcohol screening?\",\"answer\":\"Mandatory alcohol screening can be used only if you are in care and control of the vehicle, you have been lawfully stopped, and the police officer has the approved screening device available.
