It provides the findings of an INT administrative inquiry (the“Investigation”) into allegations of corrupt, fraudulent, collusive, and/or coercive practices, as defined by the WBG for the purposes of its own policies, rules and procedures (the “WBG’s Anticorruption Framework”), in relation to WBG-supported activities. The purpose of the Investigation was to allow the WBG to determine if the WBG’s Anti-corruption Framework had been violated.  \nThis Report is being shared to ensure that its recipients are aware of the results of the INT Investigation. However, in view of the specific and limited purpose of the Investigation underlying this Report, this Report should not be used as the sole basis for initiating any administrative, criminal, or civil proceedings. Moreover, this Report should not be cited or otherwise referred to in the course of any investigation, in any investigation reports, or in any administrative, civil, or criminal proceedings.  \nThis Report is provided without prejudice to the privileges and immunities conferred on the institutions comprising the WBG and their officers and employees by their respective constituent documents and any other applicable sources of law. These privileges and immunities cannot be waived without the prior express written authorization ofthe WBG.  \nBackground  \nIn April 2017, the International Development Association (“IDA” or the “World Bank”) and the Republic of Uzbekistan (“Uzbekistan”) signed a Financing Agreement for the Modernizing Higher Education Project (the “Project”) . The Project became effective in August 2017, and is scheduled to close in February 2023.  \nThe Project’s development objectives are to strengthen Uzbekistan’s higher education system managerial capacity and to improve the labor market relevance and learning environment of selected higher education institutions. The Project consists of four components: (i) strengthening higher education management; (ii) improving the learning environment in higher education institutions; (iii) improving relevance of higher education; and, (iv) project management, monitoring and evaluation.  \nAs part of the first component, the Project Management Team (the “PMT”) within the Ministry of Higher and Specialized Secondary Education of Uzbekistan issued the Invitation to Quote Shopping for Goods for Contract X in October 2017. Company A, a company located in Uzbekistan, submitted a quote for Contract X.  \nIn 2016, Company A was awarded two contracts, Contract Y and Contract Z, under two other Bank-financed projects in Uzbekistan.  \nAllegations & Methodology  \nINT received a complaint that an employee and representative of Company A, Individual M offered a kickback to a World Bank employee (the “Bank Employee”) in exchange for her/his help securing award of Contract X. The Bank Employee refused the offer and immediately reported the matter to the relevant World Bank staff.  \nINT interviewed witnesses and reviewed the Project documents.  \nFindings  \nEvidence indicates that Individual M, on behalf of Company A, offered a Bank Employee a kickback so that s/he would influence Contract X’s procurement in favor of Company  \nA.  \nEvidence indicates that, in the summer of 2017, Individual M arranged a meeting and met with the Bank Employee at the World Bank’s offices.
