It requires transparent notification, timely publication of regulatory information, use of the ASEAN Trade Repository, and a monitoring role for senior officials supported by ASEAN institutional bodies.","# MEMORANDUM OF UNDERSTANDING ON THEIMPLEMENTATION OF NON-TARIFF MEASURES ONESSENTIAL GOODS UNDER THE HANOI PLAN OFACTION ON STRENGTHENING ASEAN ECONOMICCOOPERATION AND SUPPLY CHAIN CONNECTIVITY INRESPONSE TO THE COVID-19 PANDEMIC\n\nThe Governments of Brunei Darussalam,the Kingdom ofCambodia,the Republic of Indonesia,the Lao People'sDemocratic Republic(Lao PDR),Malaysia,the Republic ofthe Union of Myanmar,the Republic of the Philippines,theRepublic of Singapore,the Kingdom of Thailand and theSocialist Republic of Viet Nam,Member States of theAssociation of Southeast Asian Nations (hereinaftercollectively referred to as“Member States”):  \nRECALLING the Declaration of the Special ASEAN Summiton Coronavirus Disease 2019(COVID-19),issued on 14April 2020,where the ASEAN Leaders reaffirmed theirdetermination and commitment,in the spirit of a Cohesiveand Responsive ASEAN,to remain united and to act jointlyand decisively to control the spread of the disease whilemitigating its adverse impact on our people's livelihood,oursocieties and economies;  \nRECALLING FURTHER the Statement on StrengtheningASEAN's Economic Resilience in Response to the Outbreakof the Coronavirus Disease (COVID-19),where the ASEANEconomic Ministers(AEM)agreed to take collective courseof action to mitigate the economic impact of COVID-19 andresolved to,among others,continue addressing non-tarifbarriers,particularly those that impede the smooth flow of  \ngoods and services in supply chains,and refrain fromimposing new and unnecessary non-tariff measures;and  \nDETERMINED to implement the Hanoi Plan of Action onStrengthening ASEAN Economic Cooperation and SupplyChain Connectivity in Response to the COVID-19 Pandemicin particular,where Member States committed to ensure thesmooth flow of essential goods,including food,medicinesand medical and other essential supplies associated withcombating the COVID-19 pandemic and facilitate timelyinformation sharing amongst the Member States with regardto trade-related measures on these essential goods andsupplies,  \nHAVE REACHED THE FOLLOWING UNDERSTANDING:  \n## SECTION 1:DEFINITIONS\n\nFor the purpose of this Memorandum of Understanding(MOU):  \na)Essential goods include food,medicines,and medicaland other essential supplies,as listed in the Appendix ofthis MOU,for the purpose of combating the COVID-19pandemic,subject to agreement by all Member States;  \nb)Rollback means the undertaking to phase out oreliminate non-tariff measures which would unnecessarilyimpede intra-ASEAN trade flows of essential goods;  \nc)Non-Tariff Measures(NTMs)refers to governmentmeasures or policies other than duties which affect tradeflows,in accordance with the rights and obligations ofthe Member States under the WTO Agreement theASEAN Trade in Goods Agreement(ATIGA),and anyother international agreements;  \nd)WTO means the World Trade Organization;and  \n(008  \ne)WTO Agreement means the Marrakesh AgreementEstablishing the World Trade Organization,done on 15April 1994 and the other agreements negotiatedthereunder.  \n## SECTION 2:SCOPE AND COVERAGE\n\n1.  This MOU will cover all types of trade restricting ordistorting NTMs applied to Essential goods.  \n2.   Member States will conform with the arrangements onessential goods under this MOU,except where exceptionalcircumstances compel them to do otherwise,in accordancewith the WTO rules.  \n## SECTION 3:RELATIONSHIP TO THE WTO AGREEMENT,ATIGA AND OTHER INTERNATIONAL AGREEMENTS\n\n1.  Nothing in this MOU prevents Member States fromexercising their rights and obligations under the WTOAgreement,the ATIGA and any other internationalagreements to which they are a Party.  \n2.
