Joey did not like Brent while they were in high school and he still does not like Brent. While reminiscing about his old football days with another patron at a local bar, and after having several strong alcoholic drinks, Joey decided to drive over to Brent’s house to confront him. Joey left the bar, got into his truck and drove across town to Brent’s house on the river. When Joey got there, he parked his truck on the street in front of Brent’s house, right in front of a fire hydrant. No one was home, but Joey decided he would go inside Brent’s house and wait for Brent to get home. Joey let himself in through a half open window. After waiting a few minutes, Joey passed out on the couch. Brent arrived home an hour later. Brent noticed Joey’s truck on the street outside of his house, and when he entered his home, he could hear loud snoring coming from the living room. Brent quietly walked back out of his house and called the police. Several minutes later, Joey awoke to law enforcement officers yelling commands through a megaphone for Joey to exit the residence with his hands raised. Joey had a felony conviction of aggravated assault, and he was not interested in going back to prison, so he grabbed one of Brent’s old shotguns and raced out the back door down to the boathouse where Brent’s boat was tied to the dock. He jumped into Brent’s boat and took off down the river, driving the boat as fast as it could go and without turning on any of the boat’s safety lights to avoid being seen by the police or anyone else. Once he got far enough down the river, Joey called his fiancée, Fiona, and told her he would text her a location and asked her to meet him at that location to pick him up. Joey arrived at a cove, pulled along the bank, and texted his location to Fiona. She responded that she would be there in 30 minutes. While waiting for Fiona, Joey took the plug out of the bottom of the boat and sank it to make sure the police would not find it. But before Fiona arrived, the police located Joey and cornered him in a wooded area on the bank of the river. During an exchange of gun fire, Joey shot and killed one of the police officers. After running out of shotgun shells, Joey surrendered to officers. \nPlease answer the following question. Explain your answer; an answer without an explanation will receive no credit. \n1.1 Identify all crimes with which Joey might be reasonably charged under Louisiana \nlaw. Include in your response all lesser included charges and explain the elements and supporting facts of each identified crime. Inside of the truck, the officers found an old high school photograph of Joey and Brent that had an “x” scratched over Brent’s face. The State intends to introduce the photograph at Joey’s trial. As the police were finishing up their investigation at Brent’s house, they called for a tow truck to remove Joey’s truck from in front of the fire hydrant. \nAfter taking Joey into custody, police officers searched his person and found his cellphone. Officers then obtained a search warrant to search Joey’s cellphone and located his text messages with Fiona about picking him up along the river as well as their call history. Detectives then went to speak with Fiona at her home. Upon arrival, detectives told her they needed her to an","cbCaimvq67l8uwv1","https://ap.wps.com/l/cbCaimvq67l8uwv1","pdf",672948,17,"English","# Question 1\n## Crimes and lesser included charges under Louisiana law\n# Question 2\n## 2.1 Challenge to officer’s search of Joey’s truck\n## 2.2 Challenge to Fiona’s statement","[{\"question\":\"What does Question 1 require examinees to do?\",\"answer\":\"Identify all crimes Joey might be reasonably charged with under Louisiana law, including lesser included charges, and explain each crime’s elements and the supporting facts.\"},{\"question\":\"What additional facts are introduced for Question 2 compared with Question 1?\",\"answer\":\"Question 2 adds the truck search findings (the altered photograph), the search warrant for Joey’s cellphone, the interview and arrest of Fiona, and Joey’s later private meeting with his priest and the resulting plan to call the priest at trial.\"},{\"question\":\"What constitutional issue is addressed in Question 2.1?\",\"answer\":\"Joey’s potential state and/or federal constitutional challenge to the officers’ search of his truck, including likely arguments by the State and whether Joey would likely succeed.\"}]","LOUISIANA STATE BAR EXAMINATION - CRIMINAL LAW, PROCEDURE AND EVIDENCE - JULY 2026 - Question 1 | PDF",1789949542,43]
