An attorney with decades of correctional litigation experience describes how courts evaluate medical-care claims using constitutional standards like deliberate indifference, while also emphasizing that institutions should follow ordered care or provide medically justified reasons to override specialist recommendations. \nThe only independent news service for the corrections professional \n# Legal Specialist Recommends HCVGuidelines To Avoid Damage Awards\n\nCorrectional institutions should develop medically based hepatitis C (HCV)treatment guidelines thatwill withstand medical and legalscrutiny, said an attorney who spe-cializes in correctional health care. \n\"Having a lawsuit filed againstyou is an occupational nazard ofworking in corrections,\"said Wil-liam Rold,a New York City attor-ney with 25 years experience in cor-rectional litigation. \n\"No matter what you do,youare going to be sued so the realquestion is how can you win.” \nCorrectional institutions shouldemploy\"reasonable protocols\"thatseek to address the individual needsof the patient by relying on medicalscience.By employing these typesof HCV guidelines, institutions areunlikely to be“successfully sued,”Rold said. \n\"Judges and lawyers tend to beconservative,\"explained Rold.\"Byand large, the courts are not goingto get ahead of the medicine.Theflip side of that is when you are ap-plying the medicine in correctionsyou cannot get too far behind themedicine either. They go together.\" \nRold gave a brief history of thelaw and corrections, explaining thatone of the earliest cases establishing \nthe public's responsibility for pay-ing for the medical care of prisonersoccurred in North Carolina in 1926when an inmate was wounded inthecourse of his arrest and the countyrefused to pay for the subsequentsurgery used to treat that inmate. \nThe North Carolina SupremeCourt said, however, the county hadto pay for the care because the per-son was incarcerated and was thusunder the care of the county. \nIn 1976,the Supreme Courtadopted the concept for the nationin the famous Estelle v.Gamblecase that established the benchmarkfor deliberate indifference. \nThe decision set a constitutionalstandard that says denying medicalcare to a prisoner violates 8thamendment safeguards against crueland unusual punishment. \n\"Sometimes,it is easier to un-derstand the concept of deliberateindifference by looking at what itdoes not cover,\"Rold said. \n\"It doesn't cover accidents ormalpractice or professional dis-agreements about the proper courseof treatment. It doesn't cover whatwe call bad outcomes. It does covergross departures from the standardof care.\" \nDuring the past 25 years,hun- \nPage 2 \ndreds of cases have resulted fromEstelle v.Gamble, establishing threebasic rights:Access to medical care, evaluation and professional judg-ment. \nRold acknowledged, however, that these three rights are not alwayseasy to apply to diseases like HCVwhere there is not a clear cut con-sensus or standard of care identify-ing who should be treated and whenthey should be treated. \nHe compares HCV care andtreatment to a continuum that startswith pure research and progressesalong the way to investigationalnew drugs, compassionate use ofthose drugs and eventual approvalof the medications by the Food andDrug Administration(FDA). \nThis leads,in turn,to a standardof care that cannot be denied orskirted. \n“The easiest way to lose a law-suit is not to give inmates the careyour own staff has ordered,\"saidRold. \n\"It is very hard to explain thatto a judge,\"he said.“So if youdon","cbCaiu4bCYsoipwb","https://ap.wps.com/l/cbCaiu4bCYsoipwb","pdf",2418360,"English","# Legal Specialist
