Unforutunately, the phrase belongs to America’s collection of beautiful fictions, nestled somewhere between Huckleberry Finn, the Tooth Fairy, and trickle-down economics.1  \n“Equal Justice Under Law” mocks the brutal, lived reality of many Americans. It tells us little about a legal system that distributes pain and privilege unevenly. There’s an obscene catalog of legal inequalities that we’ve been conditioned to either digest or ignore. Countless others remain hidden from view entirely. Let us confront only a few places where the law betrays its rhetoric and fails to live up to its own hype.  \nThe child welfare system scrutinizes motherhood through the watchful lens of class. In poor neighborhoods, mothers face the threat of losing their children because their poverty is mistaken for neglect. The mom who works two shifts and leaves her young teenage daughter in charge can be accused of negligent supervision, whereas wealthy parents who entrust their children to foreign au pairs earning poverty wages do not have to worry about a social worker pounding on their door.  \nOr picture this. A dozen migrant children are sitting in a room. They are swiveling in chairs and sitting in front of a computer for a virtual  \nimmigration court hearing. Visualize that four-year-old girl in a tie-dye shirt or the seven-year-old boy wearing a shirt with a pizza on it. The judge tells them,“The reason we’re here is because the government of the United States wants you to leave the United States. . . . It’s my job to figure out if you have to leave” and “it’s also my job to figure out if you should stay.”No parents or lawyers are present. Just shelter workers who helped the children log on for the hearing.2 The same government that insists on booster seats in cars for children’s safety somehow believes that they can navigate court
