The ruling centers on whether the youth was in custody, emphasizing voluntary arrival at the station, freedom to leave, and the interview’s focus on a different suspect. The Court reversed a Ninth Circuit opinion and upheld the admissibility of the youth’s statements. comprehensive and Iindependent news summary for the Law Enforcement Professional \n# Justices Say Age And InexperienceAre Not Factors For Invoking Miranda\n\nThe Supreme Court decided a minor's age and inexperience withlaw enforcement do not mandate po-lice must read a Miranda warning be-fore an interrogation. \nProvided the youth is not in cus-tody and free to leave at any pointwhen either the youth or parent re-quests,the justices said police couldquestion without reading a warning. \nThe high court reversed an opin-ion from the 9th Circuit, which heldpolice must factor in a juvenile's ageand experience with law enforcement. \n“The court of appeals was no-where close to the mark,\"the justicessaid. \n“Our Court has not stated that asuspect's age or experience is rele-vant to the Miranda custody analy-sis.” \nThe circuit decision had over-turned a California Supreme Courtupholding the officer's conduct.Thecircuit panel said the California courterred in that the officer's conduct was\"unreasonable\"and violated the Con-stitution for failing to read Mirandaeven though the youth was not incustody. \nBut the Supreme Court said theCalifornia decision was appropriatefor the circumstances of the interro-gation since the youth was free to \nleave at any time. \n“Certain facts weigh against afinding that [Michael]Alvarado wasin custody,\"the Supreme Court said.“The police did not transport him tothe station or require him to appear ata particular time.” \nThe case involved a police inves-tigation of a homicide and a carjack-ing in Santa Fe Springs,Calif. \nA detective learned Alvaradomight have information about thecrime and asked Alvarado's motherto bring the juvenile to the stationhouse. \nHis parents transported Alvaradoto a meeting with Los AngelesCounty Sheriff's Detective CherylComstock, who asked permission foran interview. \nThe detective questioned Al-varado for about two hours, offeringhim opportunities for breaks. His par-ents waited at the station house dur-ing the interview and took him homeafterwards. \nDuring the questioning,Alvaradoidentified the shooter and gave otherinformation that eventually led to aconviction.Although he was notcharged at the station house, policelater arrested the youth. \nAlvarado's attorney alleged aMiranda violation invalidated the \nyouth's statement. The trial court de-nied the motion, saying the interviewwas noncustodial. \nAlvarado agreed the atmospherewas friendly and that there was a freeexchange of information betweenhimself and the detective. \nThe Supreme Court said Mirandaapplies to custodial settings, whichwas not the case with Alvarado. \nThe justices said the key elementsare that the youth came voluntarily tothe police station, was told that hewas not under arrest, that he couldleave at the end of the interview andthat the focus of the inquiry was thechief suspect—a person other thanAlvarado. \nThe detective asked only that Al-varado be helpful to police in estab-lishing facts to solve the crime. \nInf.:Yarborough v.Alvarado,02-1684,Sup.Ct,June 1. \n","cbCaihze5oxISoz1","https://ap.wps.com/l/cbCaihze5oxISoz1","pdf",2623938,"English","#
