Department Coordinates PlanTo Provide HIV Care For Ex-Offenders\n\nThe Health Resources and Services Administration(HRSA)is developing a plan to use RyanWhite CARE Act funds to providemedical case management servicesfor inmates who are being releasedfrom prisons and jails. \nHRSA,the agency responsiblefor administering the CARE Act,has been working in conjunctionwith the Federal Bureau of Prisonsand the Office of the Attorney Gen-eral since June to establish a feder-ally mandated plan that will useRyan White Title I and Title ⅡCARE Act funds to provide transi-tional case management services forinmates coming out of federal andstate prisons as well as local andcounty jails. \nUnder the reauthorized CAREAct,HRSA is required to submit theplan to Congress no later than Oct. \n20. \n\"The legislation is sort oftwisting our arm and saying,'youhave to do this,\"acknowledgedIdalia Sanchez, acting director forthe Office of Policy and ProgramDevelopment at the agency'sHIV/AIDS Bureau. \n“But as somebody working inthis area and as an advocate,I don'tthink the folks who are going to be \naround that table are going to feelforced in any way. \n“This is something we know isneeded and we want to do it,\"addedSanchez.“We are going to do itright.\" \nHRSA has convened an “expertpanel”of nationally recognizedauthorities on corrections and cor-rectional discharge planning pro-grams,giving them the responsibil-ity for developing the plan,accord-ing to Sanchez. \nAs a first step,HRSA is con-ducting a\"complete inventory,\"compiling statistics and reviewingwhat works, what does not workand what can be effectively appliedin terms of transitional services andprograms for inmates,Sanchez says. \n\"We also want to make sure onthe back end that we come up withsome good practice models and canuse what works,\"Sanchez says. \nThe Ryan White CARE Act,which provides health related serv-ices to people with HIV disease andtheir families, was enacted in 1990and reauthorized in 1996 and 2000. \nUnder the reauthorized CAREAct,Ryan White funds can be usedto pay for services for inmates for as long as 180 days if the correc- tional facility is not providing those \nservices.This includes ADAP fundsif the facility is not providing medi-cations. \nIn the past, the federal govern-ment prohibited the use of RyanWhite funds for inmates who wereunder the jurisdiction of a correc-tional facility. \nThe new policy provides someflexibility, allowing CARE Actfunds to supplement but not to sup-plant services provided by correc-tional institutions. \nThe purpose of the policy is toprovide grantees flexibility in pro-viding necessary and otherwise un-available,transitional primary careand support services to incarceratedpersons in the custody of local, stateor federal correctional systems thatare either nearing release or whoseincarceration is of short duration. \nRyan White is considered thepayer of last resort, making it in-cumbent for Ryan White grantees towork with the appropriate correc-tional administrators to determinewhat health care services
