\n# IN THE ENVIRONMENT AND PLANNING REVIEW TRIBUNAL\n\nAppeal no. /2026 \nApplication no.PA/01840/26 \nENVIRONMENT AND PLANNINGREVIEW TRIBUNALST.FRANCIS DITCHFLORIANA \nApplicant:Vincent Cassar \nMicahel George Attard et \nVS. \nPlanning Authority \nAPPEAL \nI write upon instructions of Michael George Attard, holder of identity card number 7788(G)(Flat 5,\"II-Gnien\",Triq l-Imblokk tal-Francizi,Victoria,Gozo)and Pamela Formosa, holder ofidentity card number 548280(M)(Flat 3,\"II-Gnien\",Triq I-Imblokk tal-Francizi,Victoria,Gozo),and further to the decision taken by the Planning Commission in relation to theabove-captioned development permit application. \nThe senders are presently filing an appeal from the said decision, and this on the followinggrounds: \n(1)FIRST GROUND:BREACH OF POLICY P13(DC15)(EXCESSIVE MANOEUVRES &INCONVENIENCE) \nPolicy P13 of the Development Control Design Policy,Guidance and Standards 2015(DC15)establishes that vehicular access ayouts must allow vehicles to enter and leave freelywithout necessitating excessive turning movements. The policy expressly lays downthat more than three(3)manoeuvres shall be considered inconvenient and unacceptable. \nThe approved swept path plan(Document 114b)submitted by the Applicant explicitlyindicates six(6)separate manoeuvring stages (alternating forward and reverse gears)toexecute basic parking functions. \nFor instance,Car Space 1 &Car Space 4 require at least 5 to 6 distinct correctivemanoeuvres to manoeuvre in or out. \nSimilarly,Car Space 2 requires up to 4 to 6 complex forward/reverse corrections while CarSpace 3 is heavily constrained by surrounding structural walls and the domestic storeextension, forcing tightly controlled multi-point manoeuvres. \nWith all due respect, any arrangement forcing users into 4 to 6 distinct forward/reversemovements directly violates Policy P13. \n## (2)SECOND GROUND: SAFETY HAZARDS &DEFECTIVE SWEPT PATH\n\nA motor vehicle steers exclusively via its front wheels.Consequently, the kinematic sweptpath envelope followed when moving in forward gear is fundamentally different from thepath traversed in reverse. The Applicant's submitted diagrams rely on idealised,single-linecentre-path trajectories that fail to account for true front/rear body overhangs,mirror-to-mirror width, and actual steering lock limits. \nAdditionally,due to the severe spatial limitations created by structural walls, the lift core, and the domestic store extension: \n(a)Drivers are forced to negotiate tight 90-degree turns in reverse within a highly confinedcentral bay; \n(b)In multiple scenarios(particularly Car Spaces 1 and 4),drivers are effectively compelledto reverse up the 1:5 steep access ramp towards the public street, creating an unjustifiableroad safety hazard for oncoming traffic and pedestrians;and \n(c)The sanctioned layout compromises user safety and convenience, directly breaching theprimary objective of Policy P13. \n(3)THIRD GROUND:IMPOSSIBILITY OF INDEPENDENT USE &ENCROACHMENT UPON CAR SPACE 2 \nThe swept path diagram(Document 114b)clearly demonstrates that the turning radii andmanoeuvring envelopes required to service Car Spaces 1,3,4,and 5 pass directly throughand encroach upon Car Space 2.This car space, like all other car spaces in the complex, areprivately owned(most of them by the Appellants)and are not the property of the Applicant. \nSimilarly,the Appellants also enjoy rights in relation to the common area at garage level, aspresently existing-rights which this proposed permit will infringe upon. \nAdditionally,the Appellants submit that a designated parking space cannot serve as anoperational parking bay and an active manoeuvring clearance zone simultaneously.Themoment Car Space 2 is occupied by a parked vehicle, the functional turning radius for allother adjacent spaces is critically compromised or entirely eliminated. This creates aninevitable operational conflict, high risk of vehicular collision, and complete obstruction. \n## (4)FOURTH GROUND:ACQUIRED
