It provides the findings of an INT administrative inquiry (the“Investigation”) into allegations of corrupt, fraudulent, collusive, and/or coercive practices, as defined by the WBG for the purposes of its own policies, rules and procedures (the “WBG’s Anticorruption Framework”), in relation to WBG-supported activities. The purpose of the Investigation was to allow the WBG to determine if the WBG’s Anti-corruption Framework had been violated.  \nThis Report is being shared to ensure that its recipients are aware of the results of the INT Investigation. However, in view of the specific and limited purpose of the Investigation underlying this Report, this Report should not be used as the sole basis for initiating any administrative, criminal, or civil proceedings. Moreover, this Report should not be cited or otherwise referred to in the course of any investigation, in any investigation reports, or in any administrative, civil, or criminal proceedings.  \nThis Report is provided without prejudice to the privileges and immunities conferred on the institutions comprising the WBG and their officers and employees by their respective constituent documents and any other applicable sources of law. These privileges and immunities cannot be waived without the prior express written authorization ofthe WBG.  \nBackground  \nIn June 2015, the International Bank for Reconstruction and Development (the “World Bank”) and the People’s Republic of China (the “PRC”) signed a loan agreement for the Huainan Mining Area Rehabilitation Project (the “Project”) . The PRC contributed an additional funding to the Project. The Project seeks to remediate and create a public space at the Jiu Da mining site in Huainan City. The Project became effective in September 2015 and is scheduled to close in June 2021.  \nIn December 2016, Company A and Company B submitted bids for Contract X. One of five Project Implementing Agencies (the “PIA”) issued bidding documents (the “Bidding Documents”) for Contract X.  \nDuring bid evaluation, the PIA conducted due diligence and found misrepresentations in Company A’s and Company B’s bids.  \nAllegations & Methodology  \nThe PIA informed the World Bank of its findings. The World Bank Integrity Vice Presidency (“INT”) reviewed procurement documents and communicated with the PIA.  \nFindings  \nThe Bidding Documents for Contract X required that bidders prove that they had undertaken at least two RMB 68 million contracts similar to Contract X in nature and complexity, with at least one of these including a reconstruction of a mountain no less than 15 meters in height and 8000 square-meters in area (“Prior Experience Requirement”) .  \n1. Evidence indicates that Company A misrepresented its experience and submitted  \nfalsified documents in its bid for Contract X in order to meet the Prior Experience Requirement.  \nIn its bid, Company A claimed that it had performed Contract Y from April 2014 to April 2015, that purportedly included reconstructing a 50-meter high and 9000-square-meter large mountain. In support of its claim, Company A submitted four documents: a contract agreement, a notice of bid award, a certificate of completion, and an acceptance form for Contract Y.  \nHowever, evidence indicates that while Company A had been awarded and undertaken Contract Y, Contract Y did not include mountain reconstruction as claimed.
