Such drivers must carry a Driver Qualification Card (DQC) as evidence that they have obtained a periodic CPC. In order to obtain a periodic CPC, the driver must have first completed 35 hours of periodic training with an approved training centre. \nFrom 10 September 2014, it will be an offence for a person who has previously relied on his or her acquired rights, to drive a lorry professionally without a periodic CPC. \n1. Background \nThe Vehicle Drivers (Certificates of Professional Competence) Regulations 2007, for the most part, came into force on 27th March 2007. As a reminder, these Regulations set new standards for professional lorry drivers in the UK and across the EU. For the purpose of this Alert, a lorry is any vehicle falling into category C1, C1+E, C or C+E. \nThe Regulations provide for the initial qualification and periodic training of professional lorry drivers. They apply to any professional lorry driver who is a national of a Member State of the EU, or who works for an organisation established in a Member State of the EU. \nFrom 10th September 2009, a person who drives a lorry professionally is required to hold a Driver Qualification Card (DQC) . The DQC must be carried at all times whilst he or she driving professionally and produced on demand for inspection by the Police. \nIn order to obtain a DQC, new professional drivers are required to undertake theory and driving ability tests to obtain an “initial” Certificate of Professional Competence (or CPC) . \nA DQC expires after 5 years and can only be renewed if a driver has obtained a periodic CPC by completing 35 hours of training with an approved training centre. \nProfessional lorry drivers , with existing vocational licences, issued before 10th September 2009 , were not required to obtain an initial CPC. These experienced drivers have not , so far, been required to carry a DQC. \nIf an experienced driver has already completed the 35 hours of training , then he or she should already be carrying their DQC card. \nHowever, such experienced drivers are required to carry a DQC from 10th September 2014. In order to obtain the DQC, the driver must have first completed 35 hours of training with an approved training centre and obtained a periodic CPC. \n2. Staying Qualified to Drive \nAlthough this alert is aimed primarily at drivers who did not need to obtain an initial CPC, it is worth mentioning that new drivers who obtained an initial CPC after 10th September 2009 , will also need to have completed 35 hours of training with an approved training centre, 5 years from the date they got their initial qualification , in order to renew their DQC. Drivers who received their initial CPCs towards the end of 2009 , will need to have new DQCs in the not too distant future. Driving without a CPC in the UK is an offence. \n3. Further Information \nThis Alert is intended only to remind you that your drivers have obligations under these Regulations. It is sent as a reminder and does not carry any legal weight. \nIt is no substitute for you reading the Regulations themselves, or for obtaining legal advice if you need help understanding the Regulations. \nThere are certain exemptions to the application of the Regulations, which are not covered in this Alert.
